Özet
la lumière du travail de Monsieur MORIN sur le concept de l’État de droit1, cet article poursuit les événements récents qui ont eu des impacts sur l’évolution de la notion. Face à son travail de grande envergure, il a été préférable de ne pas reprendre les sujets qui ont déjà été traités dans l’oeuvre précitée; par exemple, sur l’origine du concept, sur ses fondements, le début de sa conceptualisation en droit international. Pour ces sujets, nous nous référons donc aux cours prodigieux de M. MORIN, dispensés à l’Académie de droit international de la Haye, en 1995. Cet article a, en effet, pour but de reprendre l’examen du concept là où il a été arrêté dans le travail de M. MORIN, et de poursuivre ses traces et ses lignes distinctives apparues notamment aux cours de deux dernières décennies dans la progression du droit international. Abstract
The purpose of this article is to take stock of the evolution of the concept of the rule of law in its apprehensions in international law, in particular, during the last decades. In the light of Mr. MORIN’s work on the concept of the rule of law in international law, this article follows recent events which have had an impact on the evolution of the concept. Faced with the far-reaching work of Mr. MORIN, in order to avoid unnecessary repetition it was preferable not to take up the subjects which have already been dealt with in the aforementioned work; for example, on the origin of the concept, its foundations, the beginning of its conceptualization in international law. Therefore, for these subjects, we refer to the prodigious courses of Mr. MORIN, given at the the Hague Academy of International Law, in 1995. In fact, the purpose of this article is to take up the examination of the concept where it left off in the work of M. Morin, and to pursue its traces and its distinctive lines which have emerged in particular during the last two decades in the progression of international law.
