Özet

İcra ve İflâs Kanunu (İİK) madde (m.) 89 hükmü ile takip alacaklısının, borçluya ait olmakla birlikte, üçüncü kişinin elinde bulunan mal ve alacakların haczedilebileceği düzenlenmiştir. Bu düzenleme aslen haczin konmasının sağlanması amacı ile kabul edilmiş değildir. İİK m.89 hükmü ile üçüncü kişideki mal ve alacaklara konan hukuki haczin üçüncü kişiye bildirilmesi ve bu sayede haczin etkisinin üçüncü kişi üzerinde doğması amaçlanmaktadır. Buna bağlı olarak da bu düzenleme ile takip borçlusuna ait üçüncü kişilerdeki mal ve alacakların tespitinin yapılması ve varlığının tespiti halinde de borçlunun malvarlığından çıkmasının engellenmesi sureti ile korunması ve takip alacaklısının tatmini için kullanılabilmesi sağlanmaktadır. İİK m.89 kapsamında üçüncü kişiye gönderilen birinci ve ikinci haciz ihbarnamesine, üçüncü kişi tarafından gerçeğe aykırı olarak itiraz edilmesi halinde, takip alacaklısının üçüncü kişi aleyhine İİK m.89/IV hükmü uyarınca tazminat davası açma imkânı bulunmaktadır. Bu çalışmamızda, madde metninde düzenlenen bu davanın, hukuki niteliğine ve tazminatın miktarının tespitine ilişkin doktrin tartışmaları ve Yargıtay kararları ışığında, borçlar hukuku anlamında bir tazminat davası olup olmadığı irdelenmeye çalışılacaktır.

Abstract

With the provision of Article 89 of the Enforcement and Bankruptcy Law, it is regulated that the goods and receivables of the execution creditor, belonging to the debtor, but held by the third party, can be seized. This is a regulation accepted not primarily for the purpose of securing the lien, but for the purpose of notifying the third party of the lien placed on the goods and receivables of the third party, ensuring that the lien has an effect on him as well, and the determination of this property and receivable belonging to the follow-up debtor, and in case of its existence, preventing the debtor from leaving his assets and using it for the satisfaction of the prosecuting creditor. If the third-party objects to the first and second lien notification sent to the third party within the scope of Enforcement and Bankruptcy Law m.89, the execution creditor has the opportunity to file a compensation lawsuit against the third party in accordance with the provisions of Enforcement and Bankruptcy Law article 89/IV. This study examines whether this compensation case regulated in the text of the article is a compensation case in the sense of the law of obligations in the light of the doctrinal discussions regarding the legal nature of this case and the amount of compensation as well as the Supreme Court decisions.
