Özet

Kamu davası açılmasına yönelik olarak iddianame düzenlenmesi, 5271 sayılı Ceza Muhakemesi Kanunu’na göre Cumhuriyet savcısının görevidir. Bu görev, Cumhuriyet savcısının soruşturma evresi sonunda toplanan delillerin, suçun işlendiği hususunda yeterli şüphe oluşturduğu kanaatinde olması koşuluyla yerine getirilir. Bu sebeple Cumhuriyet savcısının suçun oluşup oluşmadığına ilişkin değerlendirme yapması gerekir. Suçun oluşup oluşmadığına ilişkin değerlendirme ise ancak suçun unsurlarının incelenmesi yoluyla mümkündür. Mevcut deliller suçun her bir unsuru bakımından “yeterli şüphe” oluşturmadığı sürece iddianame düzenlenemez. Bu çalışmada, Cumhuriyet savcısının suçun unsurlarını değerlendirme yetkisinin yasal dayanakları, hukuki mahiyeti ve kapsamı, belirli ceza muhakemesi ilkeleri ve temel haklar ile uygulama bakımından önemi, Cumhuriyet savcısının suçun her bir unsuruna ilişkin değerlendirmesini yaparken gözetmesi gereken hususlar incelenmektedir.

Abstract

According to Turkish Criminal Procedure Code No. 5271, drawing up an indictment to file a public prosecution is a duty of the public prosecutor. The duty is fulfilled providing that the public prosecutor shall be of the opinion that, “at the end of the investigation phase, collected evidence constitute sufficient suspicion that a crime has been committed”. For this reason, the public prosecutor shall evaluate a crime has been committed or not. Evaluating a crime has been committed or not is probable only with evaluating the elements of the crime. An indictment shall not be drawn up unless collected evidence constituting sufficient suspicion that each element of a crime has been come into existence. In this study, the legal bases of the public prosecutor’s competence to evaluate the elements of a crime, its legal characteristic and scope, its significance in terms of particular principles of criminal procedure and fundamental rights and also judicial enforcement, the points that shall take into consideration while the public prosecutor is evaluating each element of a crime are examined.
