Özet

Teknolojinin gelişmesi, suçun önlenmesi ve kamu düzeninin korunmasına yönelik idari nitelikteki önleyici kolluk faaliyetlerinde kullanılan bilgi toplama yöntemlerinin de farklılaşmasına ve çeşitlenmesine neden olmuştur. Özellikle kolluğun önleyici nitelikteki bilgi toplama faaliyetinin doğası gereği gizli olması gerektiği düşünüldüğünde, istihbari kolluk faaliyetlerinin bireylerin temel hak ve özgürlüklerine müdahale teşkil etmesi kaçınılmazdır. Özellikle toplanan bilgilerin işlenmesi, saklanması, paylaşılması ve denetlenmesine ilişkin kanunda öngörülebilir bir dayanak olması ve keyfiliğe karşı usuli güvencelerin öngörülmesi esastır. Zira yürütülen faaliyet gizli oldukça, keyfilik riski artmakta ve denetim mekanizmasının etkin şekilde işlemesi önem kazanmaktadır. Bu çalışmada kolluğun istihbari nitelikteki yetkileri bilgi toplama özelinde ele alınarak yürürlükteki mevzuat değerlendirilecek, kişisel verileri koruma hukukunun temel prensipleri göz önünde bulundurularak yasal eksiklikler tartışılacak ve kolluğun bu nitelikteki yetkilerinin özel hayat ve aile hayatına saygı ve adil yargılanma hakkına etkilerine insan hakları perspektifinden göz atılacaktır. Sonuçta bazı tavsiyelerde bulunularak, kolluk hukuku açısından hak temelli bakış açısı geliştirilmeye çalışılacaktır.

Abstract

The development of technology caused the differentiation and diversification of information gathering methods used in administrative preventive law enforcement activities. They are aiming at preventing crime and protecting public order. Considering that the preventive information gathering activity of the police should be confidential due to its nature, it is inevitable that intelligence activities of the law enforcement agencies interfere with the fundamental rights and freedoms of individuals. In particular, regarding the processing, storage, sharing and control of the collected information, it is essential that this activity has a predictable basis which provides also procedural safeguards against arbitrariness. In fact, as long as this activity is deemed to be confidential, the risk of arbitrariness increases and the effective functioning of the control mechanism becomes important. In this study, the current legislation will be evaluated by considering the intelligence powers of the law enforcement in terms of collecting information. By taking into account the basic principles of the law on the personal data protection, and legal deficiencies will be discussed. On the other hand, the impacts of the powers of the law enforcement agencies on the right to respect for private and family life as well as the right to a fair trial will be analyzed from a human rights perspective. Finally, some recommendations will be made to develop a rights-based perspective in terms of law enforcement.
