Özet
Mülga 765 sayılı Türk Ceza Kanunu’nda (ETCK) olduğu üzere, 5237 sayılı Türk Ceza Kanunu’nda da (TCK) Yabancı Devletlerle İlişkilere karşı çeşitli suçlara yer verilmiştir. Yabancı Devlet Başkanına Karşı Suç, Yabancı Devlet Bayrağına Hakaret ve Yabancı Devlet Temsilcilerine Karşı Suç gibi. Çalışmada bu suçlardan, TCK madde 340’ta yer alan suç incelenecektir. TCK’da, devlete karşı suç olarak düzenlenen bu suç, “birden çok hukuki yararı koruyan bir suçtur. Suçun faili herkes olabilir. Suçun mağduru ise yabancı devlet başkanıdır. Suçun konusu ve hareket unsuru, işlenen suça göre değişiklik göstermektedir, çünkü kanunda özel bir suçun işlenmesinden değil, herhangi bir suçun işlenmesinden bahsedilmektedir. İşlenen suçun şikâyete tabi olması durumunda, soruşturma ve kovuşturma yapılması, “yabancı devletin şikâyeti” şeklindeki karşılıklılık koşuluna bağlı tutulmuştur.
Abstract
Various offenses Against Relations with Foreign Countries are regulated under Turkish Penal Code (hereinafter TCK), just as they were regulated within the abrogated Turkish Penal Code (hereinafter ETCK). Such as Offences Against the Head of a Foreign State, Offences Against the Flag of a Foreign State and Offences Against the Representative of a Foreign State. In the study, among these crimes, the crime regulated in Article 340 of the Turkish Penal Code will be examined. This crime, which is regulated as a crime against the state in the TCK, is a crime that protects more than one legal benefit. The perpetrator of the crime can be anyone. The victim of the crime is the foreign head of state. The subject of the crime and the actus reus of the crime is varies according to the crime committed, because the law mentions commit of any crime, not commit of a certain crime. If the investigation and prosecution of the act committed is subject to an official complaint, investigation and prosecution is subject to the condition of reciprocity in the form of “complaint by a foreign state”.
