CEZA MUHAKEMESİNDE DURUŞMANIN ALENİYETİ İLKESİNE YENİ BİR İSTİSNA OLARAK KİŞİSEL VERİLER

Özet
Duruşmaların aleni yürütülmesi, Türk hukukunda temel bir ilke olarak Anayasal düzeyde güvence altına alınmıştır. Bununla birlikte, hem Anayasa’da hem de CMK’da bu ilkeye, genel ahlâk ve kamu güvenliği olarak iki istisna kabul edilmiştir. Türk hukukunda duruşmanın açıklığının istisnaları arasında bulunmayan yeni bir istisna “kişisel veriler” olarak, CMK’nın “Duruşmada anlatılması zorunlu belge ve tutanaklar” başlıklı 209. maddenin 2. fıkrasına eklenmiştir. Bu çalışmada temelde amaçlanan ise, kişisel veri nedeniyle duruşmada belge ve tutanakların anlatılmasına sanık ve mağdur lehine kısıtlama imkânı getiren CMK md.209/2 hükmünün formüle edilişi ve bu bağlamda eksikliklerine yönelik bazı noktalara dikkat çekmektir. Bu nedenle ilk olarak bu konudaki bir düzenlemeye ihtiyacın tespitiyle mevcut düzenlemenin yerindeliği ve işlevselliği ele alınacaktır. Sonrasında düzenlemede bu imkâna sahip süjeler ile talep edilebilmesinin şartları incelenecektir. Bu incelemeyi yaparken de mehaz Alman ceza muhakemesi hukukunun düzenlemeleri ile de karşılaştırılarak Türk ceza muhakemesinde özel yaşamın -bugünkü kavramsallaştırmasıyla kişisel verilerin- duruşmada korunmasına ilişkin meseleler ele alınacaktır.
Abstract
The open court principle stands as a fundamental principle in Turkish law system. The Constitution and the Criminal Procedural Code (CPC) both ensure the publicity of criminal procedures by recognizing two exemptions as public moral and public safety. In the meantime, a new exemption as personal data is introduced by art. 209, under the title of “documents and records required to be disclosed at the hearing”, of the CPC. This study firstly seeks to reach an accurate interpretation of this legal provision, that provides the possibility of a restriction in representing documents and records in the court session at the request of the accused or victim, which leads to an abandon the principle of the openness of the court session. To that end, the study analyzes of the legitimacy and functionality of introducing such exemption by arguing whether it is an outcome of a necessity or not. Thereafter, the study displays who and under which circumstances are entitled to request for such restriction. The issues arising from the protection of privacy, personal data in today’s conceptualization, within the Turkish criminal procedure will be discussed by comparing them with the provisions of German CPC.
