Özet

Türk Ceza Kanunu’nun (TCK) 314. maddesinde, devletin güvenliğine, anayasal düzene ve bu düzenin işleyişine karşı işlenen suçları işlemek amacıyla silahlı örgüt kurulması suçu yer almaktadır. TCK madde 315’te de bu amaçla kurulan silahlı örgüte silah sağlama, suça yardımın özel bir şekli olarak, bağımsız bir suç tipi olarak düzenlenmiştir. Silah sağlama suçu, silahlı örgüte mensup olmayan herkes tarafından işlenebilir. TCK madde 315’te yukarıdaki amaçla kurulan silahlı bir örgüte, örgüt faaliyetlerinde kullanılmak amacıyla silah üretmek, satın almak, ülkeye sokmak, nakletmek, depolamak suretiyle silah sağlama cezalandırılmaktadır. Madde metnindeki “örgüt faaliyetlerinde kullanılmak maksadıyla” ibaresi, suçun özel kastla işlenebileceğini ifade etmektedir. Suçun gerçekleşmesi için failin silahlı örgütün niteliğini, amaçlarını bilmesi, böyle bir örgütün faaliyetlerinde kullanılması amacıyla silahı temin etmesi şarttır.

Abstract

Article 314 of the Turkish Penal Code (hereinafter TCK), titled armed organization, includes the crime of establishing an armed organization in order to commit crimes against the security of the state, the constitutional order and the functioning of this order. In Article 315 of the TCK, which is the subject of this study, supplying weapons to an armed organization established for this purpose is regulated as an independent type of crime, as a special form of aid to crime. The crime of supplying weapons can be committed by anyone who is not a member of an armed organization. In the article, supplying weapons to an armed organization established for the abovementioned purpose by producing, purchasing, importing, transporting and storing weapons for use in the activities of the organization is penalized. The phrase “to be used in organizational activities” in the text of the article states that the crime can be committed with a private intent. In order for the crime to take place, the perpetrator must know the nature and aims of the armed organization and must procure the weapon to be used in the activities of such an organization.
