Özet

Bu makale, İbn Sâhibü’l-hidâye (el-Hidâye sahibinin oğlu) olarak meşhur olan Nizâmüddîn Ömer b. Ali el-Merğînâni (ö. 600/1204) ve ona ait olan “Cevâhirü’l-fıkh” adlı eserini tanıtmak üzere kaleme alınmıştır. İbn Sâhibü’l-hidâye, konu tasnifini babasına ait Hidâye’nin tertibine benzer şekilde tertip ettiği bu eserinin içeriğini çoğunluğu kayıp mesabesinde olan Hanefi fıkhına ait muhtasar eserlerden derlemiştir. Bu makalede, Cevâhirü’l-fıkh’ın Türkiye’de bulunan en önemli yazma nüshalarına değinilmiş; müellife ve eserin müstensihi kardeşinin oğlu Zeynü’ddin ibn Abdurrahman’a ait mukaddimeler, müellifin gerek meseleleri serd ederken gerek bu meselelere çözüm getirirken kullanmış olduğu üslup ve bulunduğu tercihler ve yaptığı çıkarımlardaki istidlal yöntemi ele alınmış ve eserin beslenmiş olduğu kaynaklar incelenmeye çalışılmıştır. Makalenin son bölümünde eserin Hanefi literatüründeki önemi vurgulanmış ve hicri 7. yy’da yaşamış Maveraünnehir alimlerine ait eserlere ışık tutulmuştur.

Abstract

This article is meant to introduce the scholar Niẓām al-Dīn ʻUmar ibn ‘Alī al- Marghīnānī (d. 1204-600). This scholar is known with the name of Ibn Sahib al-Hidayah. His book Jawāhir al-Fiqh is the most well-known work among his books. This book includes many of Hanafiah school’s summaries Mukhtasarat which most of them were lost. Al-Marghinani classified the summaries according to his father’s category in his book Al-Hidayah. The article is meant to discuss the most important manuscripts that are located in Turkey. The article will, then, address the introductions mentioned in the book. The article will discuss the author’s methodology in explaining and addressing topics. His methodology in inference and weighting will be discussed also, in parallel with tracking the sources of the book. Finally, the conclusion will be presented to point out the importance of this book at the Hanafiah school, and to highlight the works of those scholars who come from countries located behind the river at the seventh Hijri century.
