Özet

Yapı alacaklısı ipoteği ile yapı alacaklılarına, alacaklarını teminat altınaalmak için taşınmaz üzerine bir ipotek kurdurma olanağı sağlanarak, daha önceden kurulmuş sınırlı ayni haklar karşısında, sıra itibarıyla bir imtiyazdan yararlanma hakkı getirilmiştir. Bu çalışmada, bir inşaata emek vermek ya da hememek hem de malzeme vermek suretiyle inşaatta meydana gelen değere katılanların alacaklarını elde edebilmeleri için, kanundan doğan yapı ipoteği incelenmektedir. Yapı alacaklısı ipoteği, Anayasamızın 2. maddesinde yer alan sosyalhukuk devleti ilkesinin Türk Medeni Kanunu’na somut bir yansımasıdır.Yapı ipoteğinin tescili için, malik tarafından yapı alacakları için yeterligüvencenin gösterilmemiş olması gerekir. Alacak çekişmeli olmamalı, yanimalik alacağın varlığını kabul etmiş, alacağı tanımış olmalıdır. Yapı alacağıipoteği talebi, üç aylık bir süre içinde yapılır. Üç aylık süre hak düşürücü süredir. Taşınmaz maliki, işin yapılmış olmasına rağmen, alacağı tanımaktan kaçınırsa, yük miktarını mahkeme takdir edecektir. İnşaat alacağı malik tarafından kabul edilmemiş ya da ipotek alacaklısının alacağının kesin olarak belli olmaması durumlarında yapı alacaklısı ipoteğinin geçici tescili söz konusu olur.

Abstract

With the mortgage of the building creditor, the building creditors were provided with the opportunity to establish a mortgage on the immovable property in order to guarantee their receivables, and were granted the right to benefit from a privilege in the face of previously limited limited real rights. In this article, constructor’s mortgage aiming to guarantee credits of cocontractors and craftspeople who perform operations by spendig labour or labour and material is analysed. Constructor’s mortgage is not only a reflection of the principle of “ social state” adopted by Türkish Constitution but also displays the contemporary side of Türkish Civil Law due to its protective function for labour’s value against real estate owner. For the registration of constructor’s mortgage, enough security for the credits of contractors and craftspeople should not be provided by the real estate owner. There should be no contention on the credit, it means real estate owner should accept the credits. The registration of constructer’s mortgage in land registry is claimed within 3 months. This 3 months period prescription period. If the real estate owner abstain from accepting the credits, although cocontractors and craftspeople perform their operations, the amount of payment is determined by the court. In case of disapreement on credits and undestainty on the amount of credits, provisional registration of constructor’s mortgage comes into question.
