Özet
Türk boğazlarından geçiş, tarih boyunca anlaşmalarla düzenlendiğinden ahdi bir düzene tabidir. Bu antlaşmalarda, özellikle Osmanlı İmparatorluğu’nun son dönemlerinde Türk Boğazları Stratejik bir mevki ve politik bir araç olarak ön plana çıkmıştır. Bu antlaşmalar sırasıyla; 1774 tarihli Küçük Kaynarca Antlaşması, 1809 tarihli Kale-i Sultaniye (Çanakkale) Antlaşması, 1829 tarihli Edirne Antlaşması, 1841 tarihli Londra Boğazlar Antlaşması, 1856 tarihli Paris Antlaşması, 1871 tarihli Londra Antlaşması, 1923 tarihli Lozan Antlaşması, 1936 tarihli Montrö Boğazlar Sözleşmesi’dir. Montrö Boğazlar Sözleşmesi 29 Madde, 4 Ek ve 1 Protokolden oluşmaktadır. Montrö Sözleşmesi Türkiye’ye boğazlara yönelik egemenlik haklarını artırırken 1936 yılından bugüne 80 yıl boyunca boğazlardan geçiş ve ulaşımı düzenleyen en uzun ömürlü antlaşma olma özelliğini taşımaktadır. Montrö Sözleşmesi'nin temel amacı Karadeniz'e kıyıdaş olan Ülkelerin (Türkiye, Bulgaristan, Romanya, Ukrayna, Rusya ve Gürcistan) güvenliğinin sağlanmasıdır.
Abstract
The Turkish Straits include the Çanakkale (Dardanelles) and Istanbul (Bosporus) Straits and the Marmara (Marmora) Sea between them. The Turkish Straits are the only waterways connecting the Black Sea to the Aegean and Mediterranean Seas and to the oceans through the Suez Canal and the Straits of Gibraltar. Regulation of passage through the Turkish Straits has caused many problems throughout history. Since 1936, passage through the Turkish Straits has been governed by the Montreux Convention. The Montreux Convention, which is an essential element in the context of Black Sea security and stability, has been properly and impartially implemented by Turkey for more than seven decades. The Montreux Convention Regarding the Regime of the Straits is a 1936 agreement that gives Turkey control over the Bosporus Straits and the Dardanelles and regulates the transit of naval warships. The Convention gives Turkey full control over the Straits and guarantees the free passage of civilian vessels in peacetime. According to the Montreux Convention, merchant vessels enjoy freedom of passage through the Turkish Straits (Turkish Straits Vessel Traffic Services Centre regulates the passages according to the Maritime Traffic Regulations for the Turkish Straits dated 1998), while passages of vessels of war are subject to some restrictions which vary depending on whether these vessels belong to Black Sea riparian States or not. This paper analyzes two key research questions surrounding use of the Straits: Can the Montreux Convention satisfy current balance regime in teh Blacksea Region? If balance regime in the Montreux Convention are necessary, how might they affect stability in the Black Sea?
