Özet
Bu makalede self determinasyon hakkının yirminci yüzyılda MilletlerCemiyeti ve Birleşmiş Milletler dönemleri uluslararası hukukunda geçirdiğiaşamalar; hakkın, tarihsel, siyasal ve felsefi kökleri ile birlikte özellikle 1980’liyıllardan sonra self determinasyon hakkı konusunda akademik yazındageliştirilen bazı teoriler incelenecektir.Bu bağlamda, self determinasyonun uluslararası hukukta gözetilmesiistenen siyasal bir ilkeden 1960’lı yıllarda Birleşmiş Milletler bünyesindeyapılan çalışmalarla birlikte yükümlülük doğuran bir hakka doğru evrildiğigösterilecektir. Self determinasyonun bir hak olarak değerlendirilmeyebaşlanması ile birlikte iç ve dış self determinasyon ayrımları da yapılmayabaşlanmıştır. Ancak meselenin, uluslararası hukukun diğer ilkeleri, güç ilişkileri,milliyetçilik, demokratik yönetim, kültürel haklar ve insan hakları ile olanilişkisinden kaynaklanan çok boyutlu bir yapısı vardır. Özellikle hakkınkompleks yapısı ve dış self determinasyonun bir formu olan ayrılma hakkı ilemevcut uluslararası hukuk arasındaki uyumsuzluk nedeni ile akademik yazındaself determinasyon hakkı üzerine bazı (liberal) teoriler geliştirilmiştir. Buteoriler, bu hakkı gerekçelendirmeye, kapsamını belirlemeye ve pratikuygulamasına ilişkin kısıtlamaların neler olabileceği gibi konulara odaklanmıştır.Bu çalışmada ağırlıklı olarak bu teoriler hakkında bilgi verilecektir.
Abstract
This article will examine the degrees of right to self determination in international law through the stages of the League of Nations and United Nations in the twentieth century; article also will examine historical, political, and philosophical roots of right as well as some theories developed in academic literature on the right to self-determination, especially since the 1980s. In this context, it will be shown that the self-determination is a political principle that is required to be observed in international law has evolved into a right bearing obligations with the works done in the United Nations in the 1960s. With the start of being considered self determination as a right, the distinctions between internal and external self-determinations have begun to be made. However, the issue has a multidimensional structure which originated from its relationship with other principles of international law, power relations, nationalism, democratic governance, cultural rights and human rights Especially due to its complex nature and the disagreement between the right to secession as a form of external self-determination and the existing international law some (liberal) theories on the right of self determination have been developed in the academic literature. These theories are focuses on to justify the right, to determine the scope and limitations of practical application of the right. In this study, information about these theories will be given mainly.
