Özet
Bu makale AB’nin yaşadığı çok büyük ve önemli genişleme süreçleri akabinde içine düştüğü ‘yönetilme’ sorununu anayasa tartışmaları ve akabinde gelinen Lizbon antlaşması çerçevesinde tartışmayı hedeşemiştir. AB’nin içinden geçtiği reform sürecinde yaşanılan tecrübeler, üye ülkelerinin bu sürece tepkisi ve varılmak istenilen daha demokratik bir AB tahayyülü farklı dinamikler açısından ele alınmaya çalışılmıştır. Detaylı bir şekilde anayasa krizini tasvir eden makale bu tecrübeden yola çıkılarak Lizbon antlaşmasında hangi önceliklere yer verdiğini ya da verilmek zorunda kalındığını örneklerle izah etmiştir.
Abstract
Can the Treaty of Lisbon still be ratified, after the ‘No’ vote in the Irish referendum? Or could it at least be implemented in practice, even if it is not ratified? What would be the impact of Treaty of Lisbon upon the decision making processes of the EU? This Article analysis examines each of these three issues in turn, from a legal point of view. The reason for the Treaty of Lisbon was to restore the discarded 2005 constitutional treaty. It will allow the European Union to function more successfully and democratically following its enlargement from 15 to 27 members. Does the treaty realize these aims? What exactly has been changed and what new problems will emerge as a result of these changes?
