Özet

Sevk ve İskân Kanunu’yla başlayan ve emval-i metruke olarak adlandırılan Ermenimalları sorunu, Osmanlı dönemi yapılan hukuki düzenlemelerle aşılmaya çalışılmış,aynı faaliyetler, Osmanlı mirasını devralan TBMM Hükûmetleri döneminde de devametmiştir. Lozan Barış Antlaşması’nın imzalanması ile hukuki olarak da savaş hâlisona ermiş bulunuyordu. Bu dönemde emval-i metruke ile ilgili çalışmalara devamlaiç hukuk düzenlemelerinin ve uygulamalarının Lozan Antlaşması’yla uyumlu hâlegetirilmesi için çalışılmalar yapıldı. Ancak konunun hukuken çözümü için uğraşılsabile siyaseten ve propaganda aracı olarak sürdürülmeye çalışıldığı görülmektedir. Buçalışmanın amacı Lozan sonrasında Ermeni emval-i metrukesi ile ilgili yapılan hukukidüzenlemeleri, uygulamaları ile birlikte 1928 Temlik Kanunu’nun kabulüne kadar kigeçen süreçte arşiv kayıtları ve ilgili kaynaklar ışığında ele almaktır.

Abstract

The issue of Armenian abandoned properties which started with the Relocation and Resettlement Law has been tried to overcome thanks to the legal arrangements during the Ottoman period; and the same activities continued during the governments of the Grand National Assembly of Turkey which took over the Ottoman heritage. State of war has legally and officially ended after the Treaty of Lausanne was signed. During this period, in order to make suitable the internal legal regulations and applications with the Treaty of Lausanne, some activities were carried out with the continuation of workings on the abandoned properties. However, even though the issue was tried to be solved legally, it was continued to be abused as a vehicle of political propaganda. The aim of this study is to touch upon the legal regulations organized related to the Armenian abandoned properties after Lausanne under the light of archive records and related resources with the applications until the acceptance of Disposition Law in 1928.
