Özet

Evlenme; evlenme engeli bulunmayan bekâr bir erkekle bekar bir kadının devamlı olarak, iyi ve kötü günlerin paylaşılması düşüncesi ile hukukun öngördüğü şekilde bir araya gelmeleri için yaptıkları hukuki bir anlaş- madır. Evlenecek olan taraflar; bekâr, evlenme yaşına erişmiş (medeni kanuna göre erkeğin ve kadının 17 yaşını doldurmuş olması), akıl hastası olsalar bile evlenmelerinde tıbben sakınca olmadığı resmi sağlık kurulu raporuyla kanıtlanmış, aralarında evlenme yasağı olmayan bireylerdir. Evlilik birlikteliğinin, eşlerin yerine getirmesi gereken hukuki sorumluluklara uymaması nedeniyle sonlanması, boşanma olarak tanımlanabilir. Boşanma davalarında eşlerin boşanma sebebi olarak göstermiş oldu- ğu aile içi şiddet, akıl hastalığı, iktidarsızlık, cinsel soğukluk, vajinismus, kocanın karısını fiili livataya maruz bırakması gibi tıbbi iddiaların doğru olup olmadıkları hususunun tespiti için aile mahkemeleri ve asliye hukuk mahkemelerince adli tıp uzmanları veya ilgili uzmanlık alanlarından görüş istenmektedir. Sunduğumuz bu vakada, 2012 yılında mahkeme tarafından Adli Tıp Kurumu 3. İhtisas Kurulu'na gönderilen kişinin vücudunda bulunan yanık lezyonları ile ilgili olarak, türleri, büyüklükleri, tedavilerinin mümkün olup olmadığı, bu durumun evlilik birliğini davacı açısından çekilmez bir hale getirip getiremeyeceği sorulmuştur. Kurulumuzca yapılan tıbbi muayene sonuçları ve dava dosyasından ayrıntılı bilgiler elde edildikten sonra, boşanmanın ve nedenlerinin istatistiksel oranları hakkında literatür bilgisi toplanmıştır. Böylece, evlilik birliğinin kurulmasında ve devamının sağlanmasında dikkat edilecek öne çıkan faktörler belirlenmiştir. Daha sonra, toplanan veriler ışında, eşlerin tıbbi durumlarının boşanma davaları üzerine etkileri incelenmiştir. Literatürde, tıbbi nedenli bo- şanma davalarının sınırlı sayıda yer aldığı görülmüş, kozmetik nedenlerle ilişkili bir boşanma davası ise bulunamamıştır. Çiftlere evlenmeden önce aile merkezlerinde psikolojik danış- manlık vermek, eşlerin birbirlerini iyi tanımasına fırsat vermek, aile içi şiddetin hekimlerce erken teşhisi-önlenmesi ve gerektiğinde rehabilitasyon sürecinin sağlanması, aile müessesinin ayakta kalmasında önemli parametrelerdir. Özellikle aile içi şiddet olgularının tanımlanmasında adli tıp hekimlerinin önemli bir rolü vardır.

Abstract

Marriage is a legal agreement which is carried out by a single man and a single woman with no impediment to marry in order to come together through the way prescribed by law with the idea of sharing good and bad days continuously. Individuals getting married are the ones who are single, at the age of marriage (according to civil law: man and woman over the age of 17), proven to have no medical impediment by an official health report even if they are mentally ill. Divorce can be defined as the termination of marriage union due to failures of spouses’ in obeying the legal responsibilities that they have to fulfill. Expert opinion is asked from forensic medicine specialists or from other speciality fields by family courts or civil courts for determining whether the medical claims like domestic violence, mental disorder, impotence, frigidity, vaginismus, anal sex forcement by husband, which are shown to be the cause of divorce by spouses in divorce suits, are right or not. In the case we present, for the burn lesions on the body of the person referred to the Council of Forensic Medicine 3rd Forensic Expertise Board in 2012 by the court, type and size, whether they are possible to be treated or not and whether they may make the marriage union unbearable for the plaintiff spouse or not were asked. After the results of the medical examination performed by our Board and the detailed information from the court file were obtained, the literature data about the statistical rates of divorces and its reasons were collected. Thus, the significant factors to pay attention in establishment and maintenance of the marriage union were determined. Then, we have evaluated the effects of the spouses’ medical statuses on their divorce suit through collected data. In the literature, medically reasoned divorce suits were found to be limited while no divorce suit related with cosmetic reasons were able to be found. Giving psychological counseling to couples at family centers before marriage, giving opportunity for couples to know each other well, early detection-prevention of domestic violence by physicians and providing rehabilitation process when needed are important parameters in the maintenance of family. Forensic medicine specialists have an important role especially in defining the cases of domestic violence.
