Özet

Amaç: Bu makalenin amacı, Türkiyedeçocukların ceza sorumluluğu- nun başladığı ilk yaş aralığı olan12 yaşını doldurmuş 15 yaşınıdoldurmamış çocuklarda suçunanlam ve sonuçlarını algılaya- bilme ile bunlara etki eden sos- yal-kültürel faktörlerin etkisiniincelemektir.Yöntemler: Çalışma grubu, 13-14 yaş ara- sı suç işlememiş 814 çocuktanoluşmuş; çocuklar, düşük, ortave yüksek sosyoekonomik sevi- yeyi (SES) temsil eden altı okul- dan seçilmiştir. Suçun Anlam veSonuçlarını Algılayabilme Anke- ti, verilere göre çocukların ençok işlediği suçlardan seçilerekçalışmacı tarafından oluşturul- muştur.Bulgular: Çalışma sonucunda, 13-14 yaşçocuklarının suçun anlamınıkısmen algılasalar da, suçun so- nuçlarını hiç algılayamadıklarıgörülmüştür. Çocukların huku- ki muhakemeleri, bulunduklarıkültürün ahlaki değerlerini öznelalgılayışlarıyla şekillenmiştir.Bu yaş çocukları, dikkat ve özenyükümlülüğüne aykırılıktan kay- naklı taksir içeren suçlar ilesuçların hukuki bakımdan dahaağır cezayı gerektiren niteliklihallerini algılayamamıştır. Sos- yal kültürel faktörler ise suçunanlam ve sonuçlarını algılayabil- melerine önemli derecede etkietmiştir. Alt SESe mensup olançocuklar, hangi durumların suçolduğunu daha çok bilmiş, suç- lara Türk Ceza Kanununda ya- zılandan çok daha ağır cezalarvermişlerdir. Alt SESe mensupve suç çevresinde büyüyen ço- cuklar daha fazla suça şahit ol- makta ve etiketlenmeye maruzkalmakta olduklarından; katı vecezalandırıcı olarak algıladıklarıadalet sistemindeki boşluklarıkendileri doldurmuşlardır. SESyükseldikçe ise, kişileri suça itenmotivasyonların çocuklar tarafın- dan anlaşılması zorlaşmıştır.Sonuç: Sonuç olarak, 13 ve 14 yaşın, özel- likle suçun sonuçlarını algılaya- bilme için oldukça küçük bir yaşolduğu ve ceza sorumluluğu yaşı- nın bu denli küçük tutulmasının,çocuk korunmasının hedefleriyleçelişki içinde olduğu söylenebilir.Çocuklarda ceza sorumluluğu- nun değerlendirilmesi bu para- digma ile devam ettikçe, özelliklesuç çevresinde büyüyerek deza- vantajlı konumda olan çocukların,adalet eliyle yeniden adaletsizliğeuğramasına yol açacaktır.

Abstract

Objective: This study aims to examine theperception of the legal meaningand consequences of crime andthe socio-cultural factors affect- ing these perceptions, among 13to 14 years old children, who are atthe age of criminal responsibility inTurkiye.Methods: The study sample consisted of814 subjects who haven t commit- ted any crime, selected from sixschools, representing low, middle,and high socio-economic status(SES). The Survey of Perceiving theLegal Meaning and Consequencesof Crime has been devised by theresearcher by considering the pre- vailing crimes among children inTurkiye.Results: Results showed that even though 13to 14 years old children could un- derstand the meaning of the crimemoderately, they could not under- stand the legal meaning of a crimeby no means. Their legal reasoninghas been shaped by their personalperceptions of the moral values oftheir culture. Children of these agescould not understand the crimes,which stem from contradiction tothe obligation for caution and atten- tion therefore includes negligenceand those require more severepunishment because of qualifiedcircumstances . Social and culturalfactors on the other side, affectedtheir perception of the meaning andcosequences of the crime. Chil- dren from the low SES groups weremore successful to understandwhat a crime is and they gave amore severe punishment than theTurkish Penal Code. Children fromthe low SES groups and those whogrow up in a criminal environment;since they witness crimes often andare exposed to labeling, tried to fillup the vacancy of the justice sys- tem, which is strict and punitive forthem, on their own. It gets harderfor children to understand the mo- tives to commit a crime, as the SESgets higher.Conclusion: As a result it can be said that chil- dren of 13 to 14 of age are insuffi- cient to realize the consequences ofa crime and an early responsibilityof such, does not support the ideaof protecting children. As long asthe evaluation of the crime respon- sibility among this group continueswith this paradigm, it will lead to asecond injustice by the law itself forthese children who are already dis- advantaged because of being raisedin a crime environment.
