Özet
Deniz taşımacılığı dünya ticaretinde çok önemli bir yere sahiptir. İnsansız gemilerin ise gelecekte bu sektörde kritik konumda olacağı öngörülmektedir. Uzun süredir insansız gemilerle ilgili hem özel sektör hem de devletler tarafından çalışmalar yürütülmektedir. Belirtmek gerekir ki insansız gemilerle ilgili teknik çalışmalar yapılırken, hukuki yönlerinin tartışılması ve yapılacak düzenlemeler için öneriler sunulması, sektörün insansız gemilere olan güvenini artıracaktır. Bu çalışmada, hem deniz hukukunun temel taşlarından biri olan hem de onun kadar eski bir tarihe sahip olan denize elverişlilik kavramına insansız gemilerde nasıl yaklaşılacağı ile ilgili değerlerlendirmeler yapılmıştır. Bu değerlendirmeleri ise denizde mal taşınmasını düzenleyen en önemli uluslararası anlaşmalarından olan Lahey-Visby Kuralları, Hamburg Kuralları ve Rotterdam Kuralları’na göre yapmıştır. İnsansız gemilerde denize elverişlilik kavramı ile ilgili genel bir bakış açısı ortaya konulmaya çalışılmış ve gemide mürettebatın bulunmaması ve ekipmanların durumuna ilişkin yorumlar yapılmıştır. Denize elverişliliğin geleneksel gemilerde nasıl ele alındığına değinerek, denize elverişliliğin amacının gemilerin güvenli bir şekilde seyrüsefer etmesi olduğu belirtilerek, insansız gemilerde de bu hususun odak noktası olması gerektiği sonucuna ulaşılmıştır.
Abstract
Maritime transport has an very important place in world trade. It is predicted that unmanned ships will be in a critical position in this sector in the future. Studies on unmanned ships have been carried out by both the private sector and the governments for a long time. It should be noted that while conducting technical studies on unmanned ships, discussing the legal aspects and offering suggestions for regulations to be made will increase the confidence of the sector in unmanned ships. This study made evaluations on how to approach the concept of seaworthiness, which is one of the cornerstones of the maritime law and has a history as old as it, on unmanned ships. It made these evaluations in accordance with the Hague-Visby Rules, Hamburg Rules and Rotterdam Rules, which are among the most important international conventions regulating the carriage of goods by sea. A general point of view about the concept of seaworthiness in unmanned ships has been tried to be put forward, and comments have been made regarding the absence of crew on the ship and the condition of the equipment. By referring to how seaworthiness is handled in traditional ships, it has been stated that the purpose of seaworthiness is the safe navigation of ships, and it has been concluded that this issue should be the focal point in unmanned ships.
