Abstract
In October 2020, Emmanuelle Charpentier and Jennifer Doudna were awarded the Nobel Prize for invention of CRISPR Cas9 technologies, also called "molecular scissors". After the emergence of these technologies, the last decade have witnessed an important patent race. The patenting of these new technologies is generally discussed in terms of the patentable subject matter and the criteria of ordre public/contrary to morality. On the other hand, it is generally accepted that these technologies contain novelty, inventive step and industrial application requirements. Therefore, the patent race is about the ownership of inventions, not the patentability of inventions. This new technology is also successfully used in the COVID-19 pandemic. However, uncertainties about the limits of the use of CRISPR technologies also require restrictions on the patenting of these technologies.
