Özet
Tarihsel izlekte insanlık, avcıtoplayıcı toplumdan tarım toplumuna; tarım toplumundan sanayi toplumuna; sanayi toplumundan bilgi toplumuna, bilgi toplumundan süper akıllı topluma doğru evrimsel bir gelişim süreci izlemiştir. İnsanın doğa ve nesneler dünyasına hükmetme arzusuyla harekete geçen ve geliştirilen bu ilerlemeci teknobilişsel zihin, modern teknolojinin doğmasına yol açmıştır. Yenilikçi modernizme egemen olan insanı aşma dürtüsü, ‘trans-human, gelişmiş insan ve cyborg’ gibi biçimlerde kendisini göstermektedir. Bu anlayış doğrultusunda üst-insan inşa etmeyi kendisine ilke edinen transhümanist anlayışın geleneksel sistemleri derinden etkileyecek bir potansiyelinin varlığından söz edebiliriz. Transhümanistik anlayış çerçevesinde geliştirilen insan tasavvuru üzerinden “insan haklarının” nasıl uygulanabileceğinin ve hukukun temel ilkelerinin trans-human çağına nasıl adapte edileceği belirsizliğini sürdürmektedir. Bu anlayışın egemen olduğu toplumsal yapıda hukukun sistemsel dönüşümüne ilişkin farklı gelecek öngörüleri bulunmaktadır. Teknolojik tekilliğe doğru evrilen dijital evrenin dönüştürücü etki alanlarından birisini de hukukun sistemsel işleyişinden yargısal edim süreçlerine kadar bütün hukuksal alanı kapsayan hukuk sektörü oluşturmaktadır. Nitekim bazı hukuk fütüristlerine göre, öngörüye dayalı hukuki analitik yakın bir zamanda ‘hukuki tekillik’ ile sonuçlanacaktır. Bu ‘hukuki tekilliği’ esas alan hukuk sisteminin ‘hukuki belirsizlik’ sorununu bertaraf edeceği öngörülmektedir. Ancak hukuk sisteminde yapısal bir dönüşümle ‘tek tipleştirme, uyumlaştırma ve bütünleştirme’ amacını güden ‘hukuki tekillik’ ideali, hukuk kurallarının ulusal karakterini göz ardı etmektedir. Toplumsal yapının sosyo-ekonomik ve sosyo-kültürel dinamiklerini ve derinlikli sosyolojisini dikkate almayan tekillik ideali, apolitik bir sosyal mekanizme yol açacaktır. Tekillik idealinin öngördüğü temsili onto-robotik aygıtlar, ‘adalet’, ‘hakkaniyet’ ve ‘vicdan’ yetilerine sahip olamayacaktır. Özellikle ceza adaleti açısından vicdani kanaatine göre karar veren yargıcın yapay bir akıl ile ikamesi mümkün gözükmemektedir. Bundan ötürü, hukukun temel ilkeleri dikkate alındığında yapay zeka üzerinden ceza adaletinin tahakkuku birtakım temel etikjüridik kaygıları beraberinde getirmektedir.
Abstract
In the historical path, humanity has followed an evolutionary process of development from hunter-gatherer society to agricultural society; agricultural society to industrial society; industrial society to information society, information society to super smart society. With the desire of man to rule over the world of nature and objects, the techno-cognitive mind, which is activated and developed, has led to the birth of modern technology. The drive to transcend the human that dominates innovative modernism manifests itself in forms such as ‘trans-human, advanced human and cyborg’. In line with this understanding, we can talk about the potential of the transhumanist understanding, which adopts the principle of building superhuman, has a potential to deeply affect traditional systems. It remains uncertain how ‘human rights’ can be implemented through the human imagination developed within the framework of transhumanistic understanding and how the basic principles of law will be adapted to the trans-human age. There are different future predictions regarding the systemic transformation of law in the social structure dominated by this understanding. One of the transformative domains of the digital universe, which has evolved towards a technological singularity, is the legal sector, which covers the entire legal field, from the systematic functioning of the law to the processes of judicial action. Indeed, according to some legal futurists, predictive legal analytics will soon result in a ‘legal singularity’. It is predicted that the legal system based on this ‘legal singularity’ will eliminate the ‘legal uncertainty’ problem. However, the ideal of ‘legal singularity’, which seeks ‘uniformity, harmonization and integration’ through a structural transformation in the legal system, ignores the national character of legal rules. The singularity ideal, which does not take into account the socio-economic and socio-cultural dynamics and deep sociology of the social structure, will lead to an apolitical social mechanism. Representative onto-robotic devices envisaged by the singularity ideal will not be capable of ‘justice’, ‘fairness’ and ‘conscience’. Especially in terms of criminal justice, it does not seem possible to substitute a judge who decides according to his personal conviction with an artificial reason. Therefore, when the basic principles of law are taken into consideration, the realization of criminal justice through artificial intelligence brings some basic ethical-juridic concerns.
