Özet
Avrupa İnsan Hakları Sözleşmesi’nin (Sözleşme) “özel ve aile ha yatına saygı hakkı” başlıklı 8’inci maddesinin birinci fıkrasında “herkes özel ve aile hayatına, konutuna ve haberleşmesine saygı gösterilmesi hakkı na sahiptir” denilmektedir. Görüldüğü üzere, Sözleşme’nin 8'inci maddesi kapsamında haberleşmeye saygı hakkı da koruma altına alınmıştır. Sözleşme’nin 8’inci maddesi ile koruma altına alınan hak ve öz gürlükler Anayasa’nın 20, 21 ve 22’nci maddelerine paylaştırılmış vazi yettedir. Anayasa’nın 22’nci maddesinde özel olarak “haberleşme hürri yeti” düzenlenmiş ve koruma altına alınmıştır. Maddenin birinci fıkra sında, herkesin haberleşme hürriyetine sahip olduğu ve haberleşmenin gizliliğinin esas olduğu belirtilmiştir. Çalışmamızda soruşturma ve kovuşturma evresinde bir koruma tedbiri olan telefon dinlemelerinin hukuka uygunluk kriterlerinin Sözleşmesi’nin 8 inci ve Anayasa’nın 22 nci maddesi çerçevesinde değer lendirmesi yapılmıştır. Bu kapsamda ceza muhakemesinde telefon din lemelerinin hukuka uygunluk kriterleri Avrupa İnsan Hakları Mahkeme si ve Anayasa Mahkemesi kararları incelenmek suretiyle ele alınmıştır. İstihbari, önleme ve infaza ilişkin telefon dinlemeleri ile devlet dışı üçüncü kişiler tarafından yapılan telefon dinlemeleri çalışmamızın kap samı dışında kalmaktadır
Abstract
In the first paragraph of Article 8 of the European Convention on Human Rights (the Convention) titled "right to respect for private and family life", it is stated that "everyone has the right to respect for his private and family life, his home and his correspondence." As can be seen, the right to respect for correspondence is also protected within the scope of Article 8 of the Agreement. The rights and freedoms protected by the Article 8 of the Conven tion are distributed to the 20th, 21st and 22nd articles of the Constitu tion. In the article 22 of the Constitution, "freedom of communication" is notably regulated and protected. In the first paragraph of the article, it is stated that “Everyone has the right to freedom of communication. Sec recy of communication is fundamental.” In our study, the lawfulness of monitoring of telephones, which is a protection measure during the investigation and prosecution phase, we re evaluated within the frame of the Article 8 of the Convention and the 22nd article of the Constitution. In this context, the lawfulness criteria of monitoring of telephones were dealt with by means of examining the decisions of the European Court of Human Rights and the Constitutional Court. Monitoring of telephones for intelligence, prevention and execution and by third parties (nonstate actors) are outside the scope of our study.
