Özet
Tüm dünyayı 2019 Aralık ayından beri etkileyen COVID-19 pandemisi; çok sayıda temel hakkın kullanımına müdahale edilmesine yol açmış, temel haklar rejimine ilişkin tüm tartışmalara yeni bir boyut getirmiştir. Salgının etkilediği temel hakların başında, kullanımı bulaş riskini yüksek derecede artıran toplantı ve gösteri yürüyüşü hakkı gelmektedir. Ancak salgının süresinin sanılandan uzun sürmesi, yaşam hakkı ve genel sağlığın korunması amaçları için dahi olsa demokratik toplumun yapıtaşı olan bu hakkın kullanımının ne ölçüde sınırlandırılabileceğinin daha detaylı bir şekilde irdelenmesini zorunlu kılmıştır.
Abstract
The COVID 19 pandemic, which has been affecting the whole world since December 2019, has caused to restriction many of fundamental rights and freedoms and thus, it has brought a new dimension to discussions on the regime of fundamental rights. One of this fundamental rights concerningly affected by the pandemic is the right to assembly and demonstration, the which is thought to use it can increase the risk of infection to a high level. However, the fact that the duration of the epidemic lasted longer than expected made it necessary to examine in more detail the conditions for limiting the use of this right, which is one of the essentials of a democratic society, even for the purposes of protecting the right to life and public health.
