Özet
Bu metnin birinci savı, Başlangıç’ta “görüşler” ve “ilkeler”in bulunduğu, değiştirilmezlik yasağının ilkelerle ilgili olduğu; ayrıca bu ilkelerden Anayasa’da açıkça ifade edilenler dışında, tartışmaya değer üç ilkenin bulunduğudur: Atatürk ilke ve inkılaplarına bağlılık, saldırı savaşı yasağı ve karşılıklılık ilkeleri. Metnin ikinci savı, Başlangıçta yapılan 2001 değişikliğinin bazı kanun hükümlerinin (örn. TCK md. 301) anayasallığını kuşkulu hâle getirdiğidir. Metnin üçüncü savı (esasen bulgusu) Anayasa Mahkemesinin Başlangıç kısmına verdiği anlamın 2000’li yıllarda değiştiğidir. Bu değişiklik ortaya konmuş ve literatürde güncelleme yapılması önerilmiştir.
Abstract
The Preamble of the Turkish Constitution includes both “principles” and “opinions,” the latter reflecting the official ideology of the regime. This study is based on the main argument that the eternity clause applies only to principles, not opinions. Furthermore, the paper defends that there exist three implied principles at the Preamble as following: Kemalism’s six arrows, the prohibition of war of aggression, and reciprocity. The second argument of the paper is that the 2001 amendment in the Preamble makes the constitutionality of some legal provisions (e.g., Turkish Criminal Code art. 301) questionable. The third argument and main finding of the paper is that the meaning given to the Preamble by the Constitutional Court has changed in the 2000s. This change has been revealed, and an update has been proposed to the constitutional literature.
