CİNSEL SALDIRI SUÇUNDA KADININ ETKİN KORUNMASININ TOPLUMSAL CİNSİYET PERSPEKTİFİYLE İNCELENMESİ

EXAMINATION OF EFFECTIVE PROTECTION OF WOMEN IN THE CRIME OF SEXUAL ASSAULT FROM A GENDER PERSPECTIVE

Özet

Türkiye’de ve dünya genelinde milyonlarca kadın şiddete maruz kalmakta iken gelenekler, kadının toplumda statüsünün düşük görülmesi ve kadınların ekonomik özgürlüklerinin erkeklere göre daha zayıf olması gibi sebeplerle kadına yönelik şiddet çoğu zaman gizli tutulmaktadır. Kadına yönelik şiddet fiziksel, psikolojik, ekonomik ve cinsel olabilir. Makalemizde özellikle kadına yönelik şiddetin en sık görülen ve en ağır türlerinden biri olan cinsel şiddet ele alınacaktır. Öncelikle toplumsal cinsiyet perspektifiyle kadına yönelik cinsel şiddet kısaca ele alındıktan sonra 5237 sayılı Türk Ceza Kanunu kapsamında cinsel şiddet teşkil eden davranışlar ele alınacak ve cinsel saldırı suçu ile korunan hukuki değer, suçun unsurlarının düzenleniş biçimi ve cezayı ağırlaştıran hallerin mağduru korumaya etkilerine odaklanılacaktır. Son olarak ise ceza muhakemesi sürecinde cinsel saldırı mağdurunun etkin korunmasına ilişkin olarak mağdurun beyanının esas alınması ve cinsel saldırı suçun- da uzlaştırma yasağı üzerinde durulacaktır. Böylece kadına yönelik cinsel şiddet geniş bir açıdan tartışılarak cinsel saldırı mağduru kadının etkin korunmasının gerekliliğine ilişkin olarak toplum aydınlatılmaya ve farkındalık yaratılmaya çalışılacaktır.

Abstract

While millions of women in Turkey and around the world are subjected to violence, violence against women is often kept secret for reasons such as traditions, low status of women in society and poorer economic freedoms of women than men. Violence against women can be physical, psychological, economic and sexual. In our article, sexual violence, which is one of the most common and most severe types of violence against women, will be discussed. First of all, sexual violence against women from a gender perspective will be briefly discussed, and the legal value protected by the crime of sexual assault, the way the elements of the crime are regulated, and the effects of situations that aggravate the punishment on Victim Protection will be discussed in accordance with the Turkish Criminal Code 5237. Finally, the focus will be on the basis of the victim's declaration regarding the effective protection of the victim of sexual assault in the Criminal Procedure process and the Prohibition of reconciliation in the crime of sexual assault. In this way, sexual violence against women will be discussed from a broad perspective and society will try to enlighten and awareness will be raised regarding the necessity of effective protection of women who are victims of sexual assault.
