Özet
Türk Ceza Kanunu m. 4/1 uyarınca “Ceza kanunlarını bilmemek mazeret sayılmaz.” Ceza kanunlarını gerçekten herkes bilebilir mi? Ceza kanunlarını bilmemenin mazeret sayılıp sayılmayacağı, ceza kanunlarına ilişkin bilginin mahiyetini ortaya koymakla belirlenebilir. Bu sebeple çalışmada öncelikle, hukukçu olmadığı varsayılan failin ceza kanunları karşısındaki durumu ele alınmıştır. Böylece failin bu konudaki bilgisiz liğinin hukuken ne ifade ettiği, kanunda yer alan düzenleme bağlamında hem temel ceza hukuku hem de yan ceza hukuku açısından ele alınmış tır. Bu bağlamda “ceza kanunlarını bilmemek mazeret sayılmaz” ilkesi nin tarihi kökenleri üzerinde durulduktan sonra, ilkenin anlamı ve huku ki niteliği belirlenmiş ve nihayet bu ilkenin Türk Ceza Kanunu’nda yer alıp alamayacağı konusu kritik edilmiştir.
Abstract
According to Article 4/1 of the Turkish Penal Code “Ignorance of the criminal law shall not amount to a defence.” Can anyone really know the criminal laws? Whether or not ignorance of criminal law amounts to a defence can be determined by disclosing the nature of the information about criminal law. For this reason, the study first discussed the situation of the offender, who is not supposed to be a legal scholar, against the criminal laws. In the context of the aforementioned provi sion, the legal significance of the offender's ignorance with regard to both core criminal law and supplementary penal provisions was dis cussed. In this context, after focusing on the historical roots of the prin ciple " Ignorance of the criminal law shall not amount to a defence", the meaning and legal qualification of the principle was determined and, finally, it was determined whether this principle should be included in the Turkish Penal Code.
