ÇEKTE YER ALAN CİRONUN MAHİYETİ

Özet

Çek, kambiyo senetleri arasında, hem bono hem de poliçeden daha fazla tercih edilmekte ve kullanılmaktadır. Bu durumun ortaya çıkmasının, çekin hamiline yazılı olarak düzenlenebilmesi, diğer kambiyo senetlerine nazaran hukuki sorumluluktan ayrı olarak bir de cezai sorumluluk öngörülmesi, muhatabın banka olması gibi çeşitli sebepleri vardır. Kambiyo senedi olan çek, kanunen emre yazılı bir senettir ve bu nedenle senedin devri, ciro ve zilyetliğin geçirilmesi yoluyla olur. Bu husus da göz önüne alındığında, uygulamada kapladığı alan da düşünüldüğünde çekte yer alan cironun önemi anlaşılacaktır. Çalışmamızda, çekte yer alan ciro ile ilgili önemli hususlara değinilmeye ve bilimsel görüşler ile yargı kararları doğrultusunda ele alınmaya çalışılmıştır.

Abstract

Checks are preferred and used more than both bond and draft among the bills of exchange. There are various reasons, in the emergence of this situation,. For the sake of example, the check can be issued bearer, also unlike other bills of exchange, the drawer of the check has criminal responsibility, in addition, the drawee is a bank in the check and so on. The check which is a bill of exchange is a legally promissory note. Therefore, the transfer of the check is through to endorse and transfer of possession. When all these issues and the situation in practice are taken into account, the importance of the endorsement in the check will be understood. In this study, important issues regarding endorsement in the check are mentioned and scientific views and judicial decisions are explained and discussed.
