Özet

Belediyeler kanunlarla verilen görevleri yerine getirirken personel istihdam eder. Belediyelere personel istihdamında hem kişi-görev hem de bütçesel sınırlamalar getirilmiştir. Belediyelerin personel ödemelerinin toplam tutarı bir önceki senenin bütçe gerçekleşmesinin %30’unun yeniden değerleme tutarını geçmemesi gerekmektedir. Personel ödemelerinde bütçesel sınır aşıldığında bu işlemden sorumlu kamu görevlilerine TCK’ya göre “görevi kötüye kullanma” suçu isnat edilebilir. Yargıtay’ın son aldığı kararda bu işlemin yapıldığında görevi kötüye kullanma suçunun oluştuğu düşüncesini desteklemektedir.

Abstract

Municipalities employ workers while fulfilling their duties. There are not only worker-number restrictions but also budget restrictions for municipalities in employing people. The total annual personnel expenditures of a municipality may not exceed 30% of the amount obtained by multiplying the previous year’s budget revenues by the revaluation coefficient to be determined according to the Law No. 213 on Tax Procedures. If annual personnel expenditure exceed budget limitations, the responsible public employers for this action are accused of “Embezzlement”. According to the recent decision taken by Chamber of the Court of Cassation support “Embezzlement” accusations.
