Özet
TTK 721/1'de yer alan düzenleme, noter tarafından düzenlenen protestonun bütün ihtimallerde geçerli olduğu ve bu geçerliliğini koruyacağı anlamına yorumlanmamalı, senet borçluya ibraz edilmeden düzenlenen protesto ve buna istinaden yapılan icra takibinin iptali mümkün olmalıdır.
Abstract
TTK 721/1 regulation should not be interpreted as meaning that the document of the protest prepared by the notary public is valid in any case and will maintain its validity. It should be possible to cancel the protest and the enforcement proceedings based on it without presenting the bill to the debtor.
