Özet

Vergi, hemen her toplumda devletin egemenlik gücünün bir sim-gesi olarak o toplumda yaşayan bireylerden alınmaktadır. Bizim anaya-samıza göre de herkes, mali gücüne göre vergi ödemekle yükümlüdür.2010 Anayasa değişikliği ile hukuk sistemimizde yer bulan bireysel baş-vuru hakkı ile de Avrupa İnsan Hakları Sözleşmesi kapsamındaki temelhak ve özgürlükler devletin egemenliği karşısında daha da güvencelikonuma getirilmiştir. Vergi de en temel haklardan biri olan mülkiyethakkının sınırlandırılmasıdır. Bu sebeple, çalışmamız kapsamında önce-likle anayasal vergilendirme ilkeleri üzerinde durulacak ve AnayasaMahkemesi’ne bireysel başvuru hakkı anlatılacaktır. Sonrasında iseAnayasa Mahkemesi’nin vergi ile ilgili bireysel başvuru kararları, mül-kiyet hakkı ve adil yargılanma hakkı çerçevesinde inceleme konusu ya-pılacaktır.

Abstract

Tax is taken from individuals living in society as a symbol of the power of sovereignty of the state in almost all societies. According to our constitution, everyone is obliged to pay taxes according to their fi- nancial power. With the amendment of the 2010 Constitution, the right of individual applicants to be found in our legal system and the funda- mental rights and freedoms within the scope of the European Convention on Human Rights have become more secure against the sovereignty of the state. Tax is also the limitation of the right to property, which is one of the most fundamental rights. Therefore, we will focus primarily on constitutional taxation principles and explain the right of individual ap- plication to the Constitutional Court. Subsequently, the Constitutional Court decisions will make an examination on the individual application regarding the tax within the framework of the right of property and the right to a fair trial.
