Özet

Vergi Usul Kanunu’nun 116.maddesinde tanımlanmış ve 117 ve 118 inci maddelerinde ise “Hesap Hataları” ve “Vergilendirme Hataları” adı altında iki başlık olarak zikredilmiş olan vergi hataları; mükellefin yaptığı başvuru ve idarenin teftiş, arama ve vergi incelemesi gibi durumlarda ya da ilgili memurların yada üst memurun yaptıkları çalışmalar sonucunda ortaya çıkartılabilmektedir. Vergi hatasının düzeltme işlerinde sorumlu ve görevli olarak, vergi dairesi başkanı görev yapmakta, bu görev Büyük Mükellef Vergi Dairesi Başkanlığı içerisinde ise, vergi dai-resi başkanına ait olmaktadır. Vergi hatalarının düzeltilmesi için mükellef ya da sorumluya genel olarak tarh zamanaşımı süresi içerisinde baş-vuru yapma yetkisi tanınmış olmakla birlikte, bazı özel hallerde bu süre bir yıldan fazla olarak ta uygulanabilmektedir. Vergi hataları için; mükellef dava açma süresi geçmemiş ise vergi dairesine otuz gün içerisinde başvuru yapma hakkına sahiptir ve bu başvuru esnasında dava açma süresi durmaktadır. Eğer bu başvuru noktasında kendisine vergi idaresinden ret cevabı gelir yada altmış günlük süre zarfında hiç cevap gelmediği takdirde vergi mahkemesine dava açabilmektedir. Mahkemeye dava açma süresi geçtikten sonra yapılan başvurularda ise mükellefler ilk etapta yazılı başvuruda bulunacaklar, bu talepten ret cevabı almaları üzerine Hazine ve Maliye Bakanlığı, Valilik ve ilgili Belediye Başkanlıklarına altmış gün içerisinde itiraz edebileceklerdir. Şikayet yoluyla yapılanbaşvuruya ret cevabı alır ise, bu cevabın tebliğ olduğu tarihten itibarenotuz gün içerisinde vergi mahkemesine dava açabileceklerdir.

Abstract

Taxing errors defined in article 116 of the Procedural Tax Law and mentioned under two separate headings respectively in article 117 and article 118 as “Accounting Errors” and “Taxation Errors”, can be determined through the application of the taxpayer or through the administrative inspections, searches and tax review, or as a result of the work of the relevant officers or the senior officer. The head of the tax office is responsible for the correction of taxing errors, and this duty belongs to the head of the tax office within the Taxpayer Department. In general, the taxpayer or the person responsible for paying the relevant tax is authorized to apply within the established time limit for correction of any error, but in some special cases this period may be extended for more than one year. For tax errors, the taxpayer has the right to apply to the tax office for correction within thirty days and the time limits halts while the taxpayer applies for a lawsuit. The taxpayer can sue the administration upon a refusal from the tax office, or if the administration did not no response in any way within a sixty-day period. In case of applications to the court after the deadline, the taxpayers will have to first submit a written application to the tax office, and upon receiving the rejection from this authority, the taxpayer may appeal to the Ministry of Treasury and Finance, the Governorate and the relevant Municipalities within sixty days. If they are rejected, they will be able to file a lawsuit at the Tax Court within thirty days after the official refusal.
