Özet

Kamu alacaklarının tahsili ve takip usullerini düzenleyen 6183 Sa-yılı Kanun’da yer alan teminat, alacağı güvence altına almak maksadıyla borçludan; yapılacak ilk hesaplamalara göre alacağı karşılayacak tutarda kanunda gösterilen ekonomik değerlerin garanti sağlamak için verilme-sidir.6183 Sayılı Kanun’un 10. ve 12. maddelerinde tahsil dairesince teminat olarak kabul edilen nakdi ve ayni değerler belirtilmiştir. Söz ko-nusu kanunun 11. maddesinde ise teminat olarak kabul edilen nakdi ve ayni değerlerin sağlanamaması durumunda bazı koşullarda şahsi kefale-tin de teminat olarak gösterilmesine ilişkin düzenleme yer almaktadır.Çalışmada, 6183 Sayılı Kanun’da teminat olarak kabul edilen de-ğerlerin özellikle güncel ekonomik ve teknolojik gelişmeler doğrultu-sunda güncellenmesine yönelik öneriler sunulmaktadır. Bu çerçevede, kripto paraların teminat olarak “para” kapsamında değerlendirilmesi ve fikri/sınai mülkiyet haklarının teminat olabilme özelliği analiz edilmiştir.

Abstract

The guarantee included in the Law No. 6183, which regulates the collection and follow-up procedures of public receivables, from the debtor in order to secure the receivable; according to the first calculati-ons, the economic values shown in the law in an amount to meet the re-ceivable are given to provide guarantee. In the 10th and 12th articles of the Law No. 6183, the cash and real values accepted as guarantee by the collection department are specified. In the 11th article of the aforementioned law, in case the cash and real values accepted as collateral cannot be provided, there is a regulation regarding the presentation of personal surety as collateral under certain conditions. In the study, suggestions are made to update the values accepted as guarantee in Law No. 6183, especially in line with current economic and technological developments. In this framework, the evaluation of cryptocurrencies within the scope of "money" as collateral and the ability of intellectual/industrial property rights to be a guarantee were analyzed.
