Özet

Vergilendirme işlemlerinin kişilerin temel hak ve özgürlükleriyle olan yakın ilişkisi, vergi hukukunda tebliğe ilişkin hükümlerin ayrıntılı olarak Vergi Usul Kanunu’nda düzenlenmesini gerektirmiştir. Çalışma-nın konusunu oluşturan “elektronik ortamda tebliğ” usulü ise 23.7.2010 tarihli 6009 sayılı Kanun’un 7’inci maddesi ile getirilmiştir. Böylece Vergi Usul Kanunu’nda yer alan tebligat yöntemlerine bir yenisi eklen-miş bulunmaktadır.Vergi Usul Kanunu’nun 107/A maddesinde yer alan söz konusu düzenleme, birçok noktada hukuka aykırılık barındırmaktadır. Öyle ki maddenin 2’nci fıkrasında elektronik ortamda yapılan tebligatın, muha-tabın elektronik adresine ulaştığı tarihi izleyen beşinci günün sonunda yapılmış sayılacağı hükme bağlanmıştır. Muhatabın haberdar olup olma-dığına bakılmaksızın peşin bir sonucu öngören fıkra, mükelleflerin temel hak ve özgürlüklerini göz ardı etmektedir. Başka bir hukuka aykırılık ise söz konusu maddenin 3’üncü fıkrasında Maliye Bakanlığı’na verilen yetki ile ilgilidir. Maliye Bakanlığı yetkisini, hukukun temel ilkelerine aykırı olarak, 456 Sıra No’lu Genel Tebliğ ile kullanmıştır.

Abstract

The close relationship between of the taxation procedures with fundamental rights and freedoms of persons required regulation of the provisions related to notifications of tax law in Tax Procedure Law. The subject of present study which is ‘notification in electronic settings’ as a form was brought with 7th article of act number 6009 dated 23.7.2010. Thereby, another new way of notification was added in Tax Procedure Law. The provision in question which appears in article 107/A of Tax Procedure Law hold contradictions to law at many points. In so much that, in the second subsection of the article, it is resolved that the elect-ronic notification was deemed served after the fifth day that followed its arrival to acceptor’s electronic address. The subsection which foresees an outcome in advance regardless of whether the acceptor was informed about it, ignores taxpayers’ fundamental rights and freedoms. Another contradiction to law at the third subsection of the article in question which gives authorization to the Ministry of Finance. The Ministry of Finance has used its authorization with the General Communique num-ber 456, contrary to the basic principles of the law.
