Özet
Madenler devletin hüküm ve tasarrufu altındadır. Madenlerinaranması ve işletilmesi faaliyetleri nedeniyle; devlet hakkını ödenmesikanunla zorunlu kılınmıştır. Devlet hakkının kanunla düzenlemesi mec-buriyeti Anayasa'nın hem 73'üncü maddesine hem de 168'inci maddesinedayanmaktadır. Bu çalışma ile Devlet hakkına ilişkin düzenlemelerintarh, tahakkuk ve tahsil açısından kanunilik ilkesine uygunluğu analizedilmiştir.
Abstract
Natural resources are under the guarantee and disposition of the state. Applicable laws require state share as a result of activities of ex- ploration and exploitation of natural resources. The requirement ac- cording to which state share levied on mining production shall be enact- ed by the law based on both articles 73 and 168 of the Constitution. This study analyzes the compliance of the regulation about state share regarding levy, accrual and collection with the constitutional principle of legality.
