Özet

Gelir Vergisi Kanunu'nun birinci maddesine göre, gerçek kişilerin gelirleri gelir vergisine tâbidir. Gelir bir gerçek kişinin bir takvim yılı içinde elde ettiği kazanç ve iratların safi tutarıdır. Gelir vergisinin konusu, gerçek kişilerin elde ettikleri gelirdir. Gelire giren kazanç ve iratların neler olduğu ise anılan Kanun'un ikinci maddesinde 7 başlık altında sayılmaktadır. Dolayısıyla, bir kazanç ve iradın gelir vergisine tabi tutulabilmesi için, mezkur maddede sayılan yedi gelir unsurundan birine dahil olması gerekir. Bu gelir unsurlarının vergilendirilmesi ise Gelir Vergisi Kanunu hükümlerine göre yapılır. Gelir Vergisi Kanunu'nun 85'inci maddesinin birinci fıkrası gereğince, mükelleflerin Gelir Vergisi Kanunu'nun ikinci maddesinde yazılı kaynaklardan, bir takvim yılı içerisinde elde ettikleri kazanç ve iratları için, bu Kanunda aksine hüküm olmadıkça yıllık beyanname verecekleri hususu hüküm altına alınmıştır. Bu düzenlemeye göre, Gelir Vergisi Kanunu'nda aksine hüküm olmadığı müddetçe, anılan Kanun'un ikinci maddesinde belirtilen yedi gelir unsurundan elde edilen kazanç ve iratların toplanması ve yıllık beyanname ile beyan edilmesi gerekmektedir. Gelir Vergisi Kanunu'nun 85'inci maddesinin ikinci fıkrası gereğince tacirlerle çiftçiler ve serbest meslek erbabı, ticari, zirai ve mesleki faaliyetlerinden, kazanç temin etmemiş olsalar bile, yıllık beyanname verirler. Bu hüküm şirketlerin faaliyet ve tasfiye dönemlerine şamil olmak üzere, kollektif şirket ortakları ile komanditerler hakkında da uygulanır

Abstract

According to the first article of the Income Tax Act, the income of real persons is subject to income tax. Revenue is the net amount of earnings and revenues a real person has in a calendar year. The subject of income tax is what real people get. What is the income and revenues of the income is counted under 7 headings in the second article of the law. Therefore, in order to be able to receive income and income from income tax, it must be included in one of the seven income elements listed. These income elements are taxed according to the provisions of the Income Tax Law. According to the first paragraph of Article 85 of the Income Tax Law, the taxpayers are entitled to submit an annual declaration for the earnings and revenues they earn in the calendar year from the sources stated in the second article of the Income Tax Law, unless otherwise provided in this Law. According to this arrangement, unless there is no contrary provision in the Income Tax Law, it is necessary to collect the earnings and revenues obtained from the seven income elements mentioned in the second article of the mentioned Law and to declare them with annual declaration. According to the second paragraph of Article 85 of the Income Tax Law, the farmers and the self-employed, commercial, agricultural and professional activities of the traffickers, even if they do not provide profit, give annual declaration. This provision shall also apply to the partners of the collective company as well as the comandants, as well as to the periods of activity and liquidation of the companies
