Özet

Franchising kelime olarak, isim ve işletme hakkını kullanma anlamına gelmektedir. Franchising sisteminde franchisor ve franchisee olmak üzere iki taraf bulunmaktadır. Franchisor, isim, marka ve sistemin sahibidir. Franchisee ise imtiyaz alandır. Franchising sözleşmelerinin temel unsurlarından biri franchise alanın (franchisee), franchise verene (franchisor) “franchise ücreti” ile “royality” ödemesidir. Çalışmada, yapılan bu ödemelerin 3065 sayılı Katma Değer Vergisi Kanunu karşısındaki durumu ele alınmıştır.

Abstract

Franchising means the right to use trade name, as well as the right to use operation rights. There are two parties involved in the franchising system: ‘franchisor’, and ‘franchisee’. ‘Franchisor’ is the owner of the trade name, the trademark, and the system; whereas, ‘franchisee’ is the grant holder. Two of the fundamental elements of the franchising agreements are the ‘franchising payment’, and ‘royalty’ payment that the franchisee pays to the franchisor. On this study, we address these payments, against the 3065 numbered Added Value Tax Law.
