Özet

KDV, mal ve hizmet tedavülü üzerinden alınan bir muamele vergidir. Mal ve hizmetlerin üretim aşamasındani nihai tüketim aşamasına kadar olan her süreçteki işlemleri kapsamına almaktadır. Mevcut uygulamalara göre ülkelerin vergileme yetkileri, kendi siyasi sınırları ile sı- nırlı olup, bir ülkenin başka bir ülkede meydana gelen işlemleri vergilemesi olanaksızdır. Diğer yandan, dünya ekonomisinde yaşanan gelişmeler, artık üretilen mal ve hizmetlerin yalnızca üretildikleri ülkede değil, dünyanın her yerinde tüketilebilir olmasına da olanak tanımıştır. Mal ve hizmetlerin bu şekilde tedavül etmeleri, ithalat ve ihracat işlemleri biçiminde ger- çekleşmektedir. Mal ve hizmet tedavülünde her safhada yaratılan katma değeri vergilemeyi amaçlayan KDV sistemi, bunun bünyesindeki indirim sistemi yoluyla gerçekleştirmekte, mükellefler vergiye tabi işlem bedeli üzerinden hesapladıkları vergiden, bu işleme ilişkin olarak mal ve hizmet alışları sebebiyle ödedikleri vergileri indirmekte ve kalan tutarı da vergi dairesine ödemektedirler. Ancak, ülkelerin vergileme yetkilerinin sınırları nedeniyle, bir ülkede ödenen vergilerin mal ve hizmetin tedavüle girdiği başka bir ülkede indirim konusu yapılabilmesi mümkün olamamaktadır. Böyle bir durumda ise, ülkeler arasında tedavül eden mal ve hizmetlerden mükerrer vergilemeye sebep olmaktadır. İşte, ortaya çıkan bu mükerrer vergilemenin ortadan kaldırılması için KDV teorisinde bazı modeller mevcuttur. Buna göre, KDVKnun 11 ve 12. Maddelerinde yer alan ihracat istisnası ile ilgili düzenleme gereğince bu gibi mükerrer vergilemeler ortadan kaldırılmaktadır. Ayrıca, geçici bir düzenleme olan kanunun geçici md.17 hükmüne göre de, belirtilen mükerrer vergilemeler ortadan kaldırılmaya çalışılmaktadır.

Abstract

Value added tax, is a process tax collected over the circulation of goods and services. It applies to all the processes starting with the production, and including the consumption of goods and services. Under the current applications, the tax levying authority of the states is limited to their borders; it is impossible for a state to levy taxes for procedures that occurred within the borders of another state. On the other hand, the current developments in the world economy allow the production of goods, and services in one country, and their consumption all over the world. The goods and services circulate in the form of imports and exports. The added value tax system, that aspires to cover all stages of the circulation of goods, and services, is realized through a deduction system within its structure. Taxpayers pay their final tax to the state, after they deduct the amount of taxes they paid for goods, and services, which are related to their business procedures. However, due to the limited taxation authority of the states, it is impossible to get a tax deduction for goods and services, which are produced in one country, and which are circulated in another one. In this situation, goods and services circulating between countries end up being taxed twice. Thus, within the added value tax theory, there are existing models for the purpose of eliminating this double taxation. The export exemption regulated under articles 11, and 12 of the “Added Value Tax Act”, eliminate this type of double taxation. At the same time, article 17, which is a provisional clause under the Act, serves to eliminate the aforementioned double taxation.
