Özet

Anayasanın 73(4). maddesine göre, “ Vergi, resim, harç ve ben- zeri mali yükümlülüklerin muaflık, istisnalar ve indirimleriyle oranlarına iliş kin hükümlerinde kanunun belirttiği yukarı ve aş ağı sınırlar içinde değiş iklik yapmak yetkisi Bakanlar Kuruluna verilebilir.” Bu çerçevede oran konusunda kanunla düzenleme yapılması zarureti sınırları kanunla belirlenmek suretiyle Bakanlar Kuruluna verilebilmektedir. İ stisna ve muafiyetler konusunda söz konusu yetkinin Bakanlar Kurulu tarafından kullanılması, kanunla bu yetki verilse dahi, hukuka aykırı iken bu yetki- nin, Bakanlar Kurulu haricinde baş ka bir makama ve somut olayda ol- duğu ş ekilde belediye meclislerine verilmesi Anayasaya aykırıdır.

Abstract

Under Article 73(4) of the Constitution: “....regarding the provisions of exemptions, exceptions, and discounts, and ratios, of taxes, photographs, filing fees, and similar monetary obligations, the power to make changes within the upper, and lower limits defined by law, may be delegated to the Council of Ministers.” Within this framework, this power is delegated to the Council of Ministers, under the condition that the limits of the ratio is regulated by law. For the Council of Ministers to use the afore mentioned power regarding exceptions, and exemptions, would be against the law, even if this power is delegated by law. When this is the case, the same power may not be delegated to another authority-to the town councils, as it was the situation in the material case at hand. This is against the Constitution.
