VERGİYE UYUMLU MÜKELLEF İNDİRİMİ VE MÜKELLEF LEHİNE DİĞER UYGULAMALARLA KARŞILAŞTIRILMASI

Özet
Bu çalışmada, Vergiye Uyumlu Mükellef İndirimi adı altında, gelir ve kurumlar vergilerini düzenli olarak beyan edip ödeyen mükelleflerin 2018 den itibaren hesaplanan gelir ve kurumlar vergileri üzerinden % 5 indirim yapılmasına yönelik yapılan düzenleme, vergi mükellefleri lehine yapılan diğer uygulamalar olan, erken ödeme indirimi, yeniden yapılandırmalar, vergi suçluları lehine sıklıkla çıkartılan af yasaları ile karşılaştırılarak değerlendirilmiştir. Ayrıca Maliye Bakanlığınca gelecekte yapılması planlanan düzenli mükelleflere hususi pasaport verilmesi ile düşük veya 0 faizli kredi kullandırılması kurumları hakkındaki görüşler incelenmiş ve değerlendirilmeye çalışılmıştır. Düzenli mükelleflere hususi pasaport verilmesine yönelik planların, hususi pasaport sayısını fazlaca arttıracağı, varış ülkesinde vize uygulanmasına yol açacağı ve halen elinde yeşil pasaport bulunduranların haklarının ihlaline yol açabileceği öngörülmüştür. Hangi pasaporta vize uygulanıp uygulanmayacağına karar verme hakkı varış ülkesine ait bir haktır. Düzenli mükelleflere verilecek düşük veya faizli krediler de, bu kredilerin geri dönmemesi halinde toplumun tümüne yayılabilecek sakıncalar içermekte olup, bütçe açıklarının daha da artması genel olarak vergi yükünü arttırmaya yol açabilecektir. Çalışma sonucu olarak, uyumlu mükelleflere erken ödeme indiriminin, ülkemizde sıklıkla başvurulan afların dürüst mükelleflerdeki caydırıcı etkisini önlemede faydası olabileceği, ancak asıl yapılması gerekenin, geleneksel olarak her 2-3 yılda bir af çıkartmaktan vazgeçerek, düzenli denetim ve cezalarla caydırıcılığı sağlamak olduğu, ancak ve sadece vergisini erken ödeyenlere yönelik indirimlerin eşitlik ve adalet duygularını zedelemeyeceği söylenebilecektir.
Abstract
There is a new arrangement in Turkish Personal Income Tax Code and Corporation Tax Code. According these codes, there is a new incentive for the taxpayers who pay their tax liabilities regularly. The name of the new tax incentive in the Turkish Income tax system is called Reduction of Compliant Taxpayer's Tax. These taxpayers, starting off in 2018, reduct 5 percent of their to-be-paid taxes from their total tax liabilities. There have also been other incentives in the tax system such as early payment reduction, frequently administered tax amnesties. This paper compares the new deduction with older ones already in the system in effectiveness of tax system. This paper also evaluates the prospective applications of the Finance Ministry with respect to increase tax revenues such as special passport delivery to those who pay their taxes regularly and credit with low or zero interest rate. Some concerns are raised in the paper that increased number of special passports would decrease the value of those passport in terms of visa procedures of the countries. Arrival countries would monitor the incoming visitors from Turkey with special passport and special passports would be practically similar to those regular passports. This would decrease credibility of the country in the Low or zero interest credit policy would also create some problems as well. If repayments of those credits are delayed or not paid at al, then fiscal burden of people who pay their taxes regularly would be increased since those buget deficits eventually would be financed by taxes. It is discussed in the paper that although early payment reduction for those taxpayers who pay their taxes early would be effective in terms of equality in the tax liabities (since those taxpayers were disappointed in the past when they realize that there were tax amnesties every 2-3 years). the most important policy would be eliminating tax amnesties, conducting regular tax auditing, and giving penalties to those who do not comply with the tax code.
