Özet

İnsanların temel ihtiyaçlarından birisi olan barınma ihtiyacı, dünyaya paralel olarak ülkemizde de artış göstermekte, kısa süreli konaklama ihtiyacını gündeme getirmektedir. Konutların Kısa süreli kiralanması, otel ve pansiyonlara göre daha fazla gelir elde edilmesine olanak sağlaması, müşteriler için daha kullanışlı ve hesaplı olması, hizmetin idari prosedür ve denetimden uzak hızlıca karşılanması gibi sebeplerle tercih edildiği görülmektedir. Bu durum, kumar, fuhuş vb. gibi illegal faaliyetlere imkan veren, Kolluk güçlerince aranmakta olan kişilerin barınma ihtiyacını gideren, vergisel boyutta kayıt dışı faaliyet gösterebilen bir sektöre zemin hazırlamakta, ilgili birimlere denetim ve takip yükümlülüğü getirmektedir. Çalışmamızda kısa süreli konut kiralama faaliyetinin hukuki dayanağı, vergi kanunları karşısındaki durumu mükelleflerin konuya ilişkin vergisel yükümlülükleri ele alınarak açıklanmaya çalışılacaktır.

Abstract

The need for shelter-one of the basic human needs, following the trend in the world, is also on the rise in Turkey. This raises the question of the need for short-term lodging. Some of the reasons that people prefer these are: they are available as short term rentals; they have the potential to bring in much more income compared to hotels, and bed and breakfasts; they are much more functional, and economical for customers; service is provided quickly without administrative procedures, and auditing. This facilitates illegal activities such as gambling, prostitution, etc.; it helps fugitives to take shelter; it paves the way for a sector engaged in illicit activities such as avoiding taxes; the responsibility to audit, and follow up would be on the related units. In our study, the legal basis for short term rental activities, its status before the tax laws, the tax liability of the tax payers, will be discussed.
