Özet

Vergilendirme süreci boyunca devlet, vergi ödevlilerinin, hatta bazen de vergilendirme ilişkisinin tarafı olmayan üçüncü kişilerin, kişisel bilgilerini edinmektedir. İnternet ve yeni veri depolama teknolojilerinde yaşanan gelişmeler, vergi idaresinin de veri toplama, depolama ve işleme yöntemlerinde değişiklik yaşanmasına yol açmıştır. Buna verilebilecek en iyi örneklerden birisi de vergi Usul Kanun'unda düzenlenen vergi ilanlarının yayım yerinin internet siteleri olarak değiştirilmesidir. Vergilerin ilanı; bilgi edinme hakkı bağlamında bireyleri yönetimin etkinlikleri, yetkileri ve kararları konusunda bilgi sahibi yaparak, kamu otoritelerinin denetlenmesini ve kamu hizmetinin etkin bir şekilde güvence altına alınmasını sağlar. Bu yeni düzenlemeler ile ilanların, vergi güvenliğine ve toplumda vergi bilinci oluşturmasına daha etkin bir şekilde hizmet etmesi amaçlanmaktadır. Ancak bu noktada temel hakları da ilgilendiren farklı bir tartışmanın konuya dahil olması kaçınılmazdır. Vergisel bilgilerin internet ortamına yüklenmesi ile halka mal olmuş şirketlerin olduğu kadar bireylerin de vergi sırları süresiz bir şekilde topluma açık hale gelecektir. Zira verilerin dijitalleşmesiyle kullanıcıların sahip olduğu kopyalama ve depolama imkanı, internete yüklenen bir verinin, yükleyen tarafından silinse bile, yok olmasını engellemektedir. Bu durum bilgi edinme hakkı konusunda bir devrim olduğu kadar vergisel bilgileri koruyan vergi mahremiyeti açısından da bir tehdit niteliğindedir. Çünkü bilgi edinme hakkı demokratik devletin şeffaflık ilkesini sağlarken vergi mahremiyeti ise bireylerin devlet karşısında şeffaflaşmasını önlemektedir. Vergi uygulamasındaki bu yeni gelişmenin "üstün bir kamu yararı olmadığı sürece, dijital hafızada yer alan geçmişte yaşanılan olumsuz olayların bir süre sonra unutulmasını, başkalarının bilmesini istemediği kişisel verilerin silinmesini ve yayılmasının önlemesini isteme hakkı" olarak tanımlanan unutulma hakkı ışığında ele alınması gerekmektedir. Bu çalışmada vergi idaresinin bilgi edinme hakkı ve vergi mahremiyeti arasında nasıl bir denge kurduğu vergi ilanları usulü üzerinden tartışılacaktır.

Abstract

Throughout the taxation process, the state acquires personal information of taxpayers, and sometimes third parties who are not part of the taxation relationship. Developments in the Internet and new data storage technologies have led tax administrators to change their data collection, storage and processing methods. One of the best examples of this is the change of the publication place of the tax lists regulated in the Tax Procedures Law to internet sites. In the context of the right to information, announcement of taxes; by providing information on the activities, authorities and decisions of the administration, ensure that public authorities are audited and public service is effectively safeguarded. These new regulations and publications are intended to serve tax security and tax awareness in the society more effectively. However, it is inevitable that a different debate involving fundamental rights at this point is involved. With the installation of tax information on the internet, the tax secrets of the individuals as well as the companies that are owned by the public will be unpackaged for an indefinite period of time. Because of the digitalization of the data, the ability of the users to copy and store it prevents the data being downloaded from the internet from being destroyed even if it is deleted by the uploader. This is a revolution in the right to information, as well as a threat to tax privacy, which protects tax information. Because the right to obtain information provides the principle of transparency of the democratic state, while the privacy of the tax prevents the transparency of individuals against the state. This new development in tax practice needs to be addressed in the light of the right to be forgotten, defined as "the right to demand to be forgetten for the negative events in digital memory after a certain time, to delete personal data that undesired to known by others and to prevent their spread, as long as there is no superior public benefit". In this study, the balance between the tax authorities' right to obtain information and tax confidentiality, will be discussed through the tax publication procedure.
