Özet

Harçlar Kanunu ile genel bütçeye dâhil kamu idareleri yargı har-cından bağışık tutulmuştur. Özel kanunlarında hüküm olmadıkça genelbütçe dışında kalan özel bütçeli idarelere bu istisna tanınmamıştır. Yük-seköğretim Kanunu hem özel bütçeli birer idare niteliğinde olan devletüniversitelerini hem de özel bütçeli idare olmamalarına rağmen vakıfüniversitelerini Harçlar Kanunu'nun genel bütçeli idarelere tanımış oldu-ğu yargı harcı istisnasından yararlandırmıştır. Buna karşılık özel bütçelibir idare olan Yükseköğretim Kurulu’na ise yargı harçları konusunda birmuafiyet ya da istisna tanınmamıştır. Oysaki Yükseköğretim Kurulu tümyükseköğretimi düzenleyen, üniversitelerin faaliyetlerine yön veren, ka-nunla kendisine verilen görev ve yetkiler çerçevesinde özerkliğe ve ka-mu tüzel kişiliğine sahip olan ve Yükseköğretim Denetleme Kurulu'nunbağlı bulunduğu bir idaredir. Bu çalışmanın konusunu; devlet-vakıf ay-rımı yapılmaksızın tüm üniversitelere yargı harcı istisnası getirilirken, buistisnanın Yükseköğretim Kurulu'na tanınmamış olmasının ortaya çıkar-dığı çelişki ve sakıncalar ile bunların çözümüne yönelik somut önerileroluşturmaktadır.

Abstract

According to Act of Fees, public administrations included in gen- eral budget are exempted from judicial fees. This exemption is non- recognized for special budget administrations out of general budget; unless there are provisions in their special acts. According to the Act of Higher Education, both public universities characterized as special budget administration and foundation universities although not charac- terized as special budget administration, are made eligible for judicial fee exemption which is applicable for general budget administrations. On the contrary, any dispensation or exemption has not been recognized for The Higher Education Council which is a special budget administra- tion. However, The Higher Education Council is an administration which regulates all the higher education, directs activities of universi- ties, has autonomy and legal entity within the frame of tasks and au- thority given by law and which is affiliated to Higher Education Super- visory Board. The situation created by the fact that while judicial exemp- tion is applicable for all universities regardless of whether they are pub- lic or private, it’s not applicable to the Higher Education Council and the discrepancies and inconveniences this generates as well as concrete suggestions directed for solutions, constitute the scope of this study.
