Özet

Hüküm dışı kavramı hesap yargısında kullanılan bir kavramdır. Bukavramla anlatılmak istenen davaya konu edilen hususun hükme bağlanmasının ertelenmesidir. Hüküm dışı kararı ancak 6085 sayılı SayıştayKanun’un 50’nci maddesinin üçüncü fıkrasında belirtilen hallerde verilebilir. Bu kavramın 6100 sayılı Kanun’daki karşılığı ise bekletici sorundur.Bilindiği üzere hesap yargısının konusu sorumluların kamu zararına yol açan hesap ve işlemlerinin hükme bağlanmasıdır. Sayıştayınhükme bağlama görev ve yetkisi ile ilgili olarak mülga 832 sayılı Sayıştay Kanunu’nun 66’ncı maddesinde iki yıllık süre öngörülmüşken, 6085sayılı Kanun’da buna benzer bir süre öngörülmemiştir.Ancak 5018 sayılı Kamu Mali Yönetimi ve Kontrol Kanunu’nun74’üncü maddesinde kamu zararından doğan alacaklarda zamanaşımıkurumu kabul edilmiştir. Her ne kadar mahkemeler zamanaşımını resendikkate alamazlarsa da tarafların itirazı üzerine dikkate almaları zorunludur. Bir alacağın zamanaşımına uğradığından bahsedilmesi için zamanaşımını kesen ve durduran hallerin söz konusu olmaması gerekir. Bu kapsamda makalemizde hesap yargısında hüküm dışı kararının zamanaşımına etkisi incelenecektir.

Abstract

The term of “exclusion from judgement” is a concept used in trial of accounts. It is the postponement of the matter subject to the case that is intended to be explained with this concept. “Exclusion from judgement” decision can only be given in cases specified in the third paragraph of article 50 of the TCA Law No. 6085. The equivalent of this concept is defined as “prejudicial problem” in Law No. 6100. As it is known, the subject of trial of accounts is to take final decision on matters related to public loss arising from the accounts and transactions of those responsible. A two-year period was envisaged in the 66th article of the Law No. 832 on the Court of Accounts about the duty and authority of taking final decision in question, whereas a similar time was not envisaged in the Law numbered 6085. However, in the 74th article of the Public Financial Management and Control Law No. 5018, a limitation period was accepted for claims arising from public loss. Although courts cannot take into account the limitation period ex officio, they are obliged to take into consideration upon the objection of the parties. In order to mention that limitation period is expired for a claim, there should not be any case that stops or restarts the limitation period. In this context, this article will examine the effect of the exclusion from judgement decision on limitation period.
