Özet
6183 sayılı Kanun, Kanun kapsamına giren kamu kurumlarınınkamu hukuku ilişkisinden doğan alacaklarının tahsilinde kullanılan birusul hukuku olup, alacakların cebren tahsilinde kamu kurumlarına genelhükümlere tâbi usul hukukuna kıyasen önemli yetkiler ve ayrıcalıklarvermektedir. Kamu kurumları, kanun kapsamındaki alacaklarının takibibakımından bu yetki ve ayrıcalıkları kullanabilmek için şekli ve hukukimahiyeti aynı Kanun’da tanımlanan “ödeme emri” düzenleyip tebliğetmektedirler. Ödeme emri tebliğ edilmeden cebri takibe başlanabilmesimümkün olamamaktadır. Ödeme emrine konu olan borcun tahakkukaşamasında ayrıntılı itiraz ve kesinleşme süreçlerine tâbi olması nedeniyle ödeme emrine itiraz sebepleri sınırlandırılmış; borçlunun, ödeme emrine yaptığı itirazın yargı makamlarınca reddedilmesi halinde de borcu%10 zamla birlikte ödeyeceği hükme bağlanmıştır. 6183 sayılı Kanunkapsamına girmeyen bazı kurumların, belirli bazı alacaklarının 6183 sayılı Kanun’a göre takip edilebileceğini öngören düzenlemeler de mevcuttur. Bu kurum ya da şirketlerin, 6183 sayılı Kanun’da tanımlananödeme emri düzenleme yetkileri bulunmadığından, alacağa itirazın reddihalinde %10 zam tahakkuk ettirebilmeleri mümkün değildir.
Abstract
Law No. 6183 is a procedural law used in the collection of receivables arising from the public law relationship between public institutions covered by this Law, and gives the public institutions important powers and privileges in comparison with the general provisions of the procedural law. In order to use these powers and privileges in terms of tracking the receivables covered by the law, public institutions issue and notify the "payment order" whose form and legal nature are defined in the same Law. It is not possible to start a forced follow-up without notification of the payment order. As the debt subject to the payment order is subject to detailed objection and finalization processes at the accrual stage, the reasons for objection to the payment order are limited; In the event that the debtor's objection to the payment order is rejected by the judicial authorities, it has been decided that he will pay the debt with a 10% increase. There are also regulations that envisage that certain institutions that do not fall under the scope of Law No. 6183 can be followed in accordance with Law No. 6183. Since these institutions or companies do not have the authority to issue payment orders defined in Law No. 6183, it is not possible for them to accrue a 10% increase in case of objection to the receivable.
