Özet
İdarenin bilerek veya bilmeyerek, kusurlu ya da kusursuz yapılaneylem ve işlemleri sebebiyle bir zarar doğması durumunda bu zararıntazmin edilmesi idare hukukunda idarenin mali sorumluluğu kavramınıdoğurmaktadır. Fransız Uyuşmazlık Mahkemesi'nin 8 Şubat 1873 tarihliBlanco kararıyla devletin mutlak sorumsuz olduğuna yönelik kabul terkedilmiş olup bunun yerine devletin sorumluluğu ilkesi kabul edilmiştir.Blanco kararı için devletin sorumluluğuna ilişkin önemli bir karar olmasısebebiyle, tüm Dünya hukuk sistemlerinde devletin sorumluluğunun temelinive idari sorumluluk hukukunun kilometre taşını oluşturduğunusöyleyebiliriz. Blanco kararıyla ortaya çıkan kamu hizmeti ölçütüne göre,mahalli veya milli, idari veya ticari nitelikte olsun, kamu hizmetlerininkuruluş ve işleyişine ilişkin tüm faaliyetler idari faaliyeti oluşturur ve bu sebepten dolayı idare hukukuna tabidir ve netice olarak da bu uyuşmazlıklaridari yargının görev alanına girmektedir. İdarenin özel hukukkapsamında olan faaliyetlerinde ise, idare özel hukuk kişileriyle eşit şartlardaolduğundan idarenin sorumluluğunun kapsamı kamu hukukunagöre tespit edilmez ve uyuşmazlıklarda idari yargı görevli değildir.
Abstract
In the event of a damage caused by the administration's knowingly or unknowingly, flawed or flawless actions and transactions, the compensation of this damage creates the concept of financial responsibility of the administration in administrative law. The French Dispute Court's decision of Blanco dated February 8, 1873 that the state was absolutely irresponsible was abandoned and instead the principle of the state's responsibility was accepted. Since it is an important decision regarding the responsibility of the state for the Blanco decision, we can say that it constitutes the basis of the state's responsibility in all world legal systems and the milestone of administrative responsibility law. According to the public service criterion that emerged with the Blanco decision, all activities related to the establishment and functioning of public services, whether local or national, administrative or commercial in nature, constitute administrative activity and are therefore subject to administrative law and consequently these disputes fall under the jurisdiction of the administrative judiciary. In the activities of the administration within the scope of private law, since the administration is under equal conditions with private law persons, the scope of the administration's responsibility is not determined according to public law and the administrative judiciary is not in charge of disputes.
