Özet
Çalışması klasik anlamda bir işçiye benzemeyen, kesintili ve düzensiz olan konut kapıcıları çok kere aile fertlerinin de yardımını almak suretiyle çalışmaktadır. 4857 sayılı İş Kanunu ile birlikte hiçbir ayrım olmaksızın konut kapıcılarının İş Kanunu'na tabi olduğu hususu tartışma dışı olmakla birlikte kapıcılık hizmetinin, aralıklı ve genellikle düzensiz olarak ifa edilmesinden dolayı kendine özgü özellikleri vardır. Bu itibarla konut kapıcılığı, kapıcılık işinin özellikleri nedeniyle özel düzenlemeleri gerekli kılmaktadır. Nitekim bu hususta İş Kanunu'nun 110. maddesine dayanılarak Konut Kapıcıları Yönetmeliğidüzenlenmiştir. Çalışmamızda İş Kanunu ve ilgili Yönetmelik çerçevesinde kapıcılarla yapılan iş sözleşmesinin mahiyeti, konut işvereni ve konut kapıcısının yetki, görev ve sorumlulukları, kapıcıların çalışma koşulları ve nihayet kapıcılarla yapılan iş sözleşmesinin sona ermesinin sonuçları üzerinde durulmuştur. Bu noktada belirtmek gerekir ki; kapıcılık mesleğine özgü olarak özellik gösteren fazla çalışma, ara dinlenmesi, kıdem tazminatı gibi hususlar üzerinde yoğun bir şekilde durulmuşken, özellik göstermeyen yıllık ücretli izin, hafta tatili vb. konular yüzeysel olarak ele alınmıştır.
Abstract
Superintendents, whose work is not like a workmen in the classical sense, but intermittent and irregular often work with the help of the family members. Even though the fact that the superintendents are subject to the labor law after the Labor Law No. 4857 without any distinction is off the table, as superintendents' work is executed intermittently and often irregularly, it has its own characteristics. In this respect, the superintendence requires special arrangements due to the characteristics of the superintendents' work. As a matter of fact, in accordance with Article 110 of the Labor Law, the Regulation on the Superintendents was arranged. In our study, the nature of the employment contract made with the superintendents, the employer and the authority, duties and responsibilities of the superintendents and the working conditions of the superintendents and finally the consequences of the termination of the employment contract made with the superintendents were highlighted in the context of the Labor Law and the relevant Regulations. At this point it should be noted that while there is a lot of emphasis on such things as overwork, rest break and severance pay, which are specific to the profession of superintendence, topics such as paid annual leave, weekend, etc. that do not have special features are handled superficially.
