Özet
İş sözleşmesinin sona ermesinden sonra işçinin işverenle rekabet etmesini yasaklayan sözleşmelerden doğan uyuşmazlıkların hangi mahkemelerde çözümleneceği, hukukumuzu uzun süreden beri meşgul eden önemli bir sorun olmuştur. Yargıtay Hukuk Genel Kurulu önceleri bu uyuşmalıklarda iş mahkemelerinin görevli olduklarına hükmetmiş iken, bir süre sonra görüşünü -mevcut düzenlemelere uygun olarak- değiştirmiş ve ticaret mahkemelerinin görevli olduklarını kabul etmiştir. Yüksek mahkemenin bu görüşü, istikrar kazanan bir içtihat hâline de gelmiştir. Ancak, 7036 sayılı yeni İş Mahkemeleri Kanunu’nun bu konuda iş mahkemelerini görevli kıldığına dair bir düzenleme getirdiğini ileri süren yeni bir görüş, eski tartışmaların yeniden alevlenmesi ihtimalini gündeme taşımıştır. Bu incelemede, sorunun gelişim süreci öğretideki görüşler ve yargı içtihatları çerçevesinde ele alınmakta; yeni İş Mahkemeleri Kanunu’nun rekabet yasağı sözleşmelerinde görevli mahkeme konusunda mevcut düzenlemelerden farklı bir hüküm getirip getirmediği saptanarak olması gereken hukuk konusundaki görüşlerimiz ortaya konulmaktadır.
Abstract
There is a deep controversy about the problem which court is in charge for the disputes arising from contracts that prohibit the employee to compete with the former employer after the termination of the labour contract. The Court of Cassation had previously decided that the labour courts were in charge but after a while changed its opinion and accepted that the commercial courts were in charge for such disputes. According to a new opinion based on the new Labour Courts Code (No. 7036), the labour courts will be in charge from the date of entry into force of the new Code. This opinion raises the possibility of revival of the old debate in this field. Aim of this article is to reevaluate this problem from this point of view.
