Özet
Günümüz iş hayatında iş verenlerin iş yerlerindeki bir kısım iş leri, bu iş te uzmanlaş mış alt iş verenler eliyle gerçekleş tirmeleri oldukça yay- gınlık kazanmış tır. Bu kapsamda, dönemin iş yasası ile asıl iş veren alt iş veren iliş kisinin unsurları, geçerlilik ş artları ve buna aykırılığın yaptı- rımları düzenlenmiş tir. Yasaların aradığı ş artlara göre alt iş verene veri- lebilecek iş ler bakımından da bir takım sınırlamalar öngörülmüş tür. Bu sınırlamalar asıl iş verene, alt iş verene ve asıl iş veren alt iş veren iliş kisi kapsamında yapılacak iş e ait olmak üzere farklı esaslara iş aret etmekte- dir. Yasa, sadece asıl iş verene ait yardımcı iş lerin ve yine yasadaki ş art- lar dahilinde asıl iş in bir bölümünün alt iş veren tarafından yapılabilece- ğini öngörmüş ancak asıl ve yardımcı iş in açıkça bir tanımına yer ver- memiş tir. Bu manada asıl iş ve yardımcı iş kavramlarının uygulamadaki karş ılığı ve içeriği, doktrin açıklamalarında, yerel mahkeme ve Yargıtay kararları çerçevesinde oluş muş tur. Abstract
It is quite common in todays business life for the employers to perform certain jobs at their places of work through sub-employers who are specialized in their respective fields. Within this context, the labor act of the time regulated the elements and conditions of validity pertaining to the relation of main employer and sub-employer, and the sanctions against inconsistencies with these conditions. Certain limitations have been set forth in terms of the jobs delegable to sub- employers according to the conditions stipulated by the act. Such limitations refer to various elements with regards to the main employer, sub-employer and the job to be performed within the frame of the relation between the aforementioned parties. The act stipulates that only the assisting jobs belonging to the main employer and a certain part of the main job, within specified conditions, can be performed by the sub- employer, yet it does not provide a clear definition of main and assisting jobs. In this sense, the practical equivalent and the content of the main job and assisting job concepts have been formed within the framework of doctrine statements, and local courts and Supreme Court decisions.
