4447 SAYILI KANUN’UN ESNAF AHİLİK SANDIĞI’NA İLİŞKİN HÜKÜMLERİ VE DEĞERLENDİRİLMESİ

Özet

Tarihsel süreç içerisinde genel itibarıyla bağımlı çalışanlar için getirilen işsizlik sigortası, 2017 yılında 6824 Sayılı Yasa ile 4447 Sayılıİşsizlik Sigortası Kanunu’na bir madde (ek md.6) eklenmesi ile bağımsızçalışanları da kapsamına alacak biçimde köklü bir değişime uğramıştır.Bağımsız çalışanların özellikle ekonomik kriz dönemlerinde sosyo ekonomik bir risk olarak işsizlik ile karşı karşıya kalmaları mümkün olduğundan işsizlik sigortasının kapsamının bu yönde genişletilmesi olumlubir adım olarak değerlendirilebilir. Hizmet sözleşmesine tabi olmayanbağımsız çalışanlar için oluşturulan ve işsizlik rizikosunu teminat altınaalmayı amaçlayan zorunlu sigorta sistemi kapsamında kurulan sandığınadı Esnaf Ahilik Sandığı olup, ek md.6’da bu sigortanın yapısı, finansmanı, kapsamı, sigorta kapsamında sağlanacak edimler gibi hususlardüzenleme konusu yapılmıştır.

Abstract

Unemployment insurance, which was introduced for dependent employees in the historical process in general, has undergone a radical change in 2017, with the addition of an article (annex art.6) to the Act No. 6824 and the Unemployment Insurance Code No. 4447. Since it is possible for self-employed to face unemployment as a socio-economic risk, especially in times of economic crisis, expanding the scope of unemployment insurance in this direction can be considered as a positive step. The name of the fund, which was created for the independent employees who are not subject to the service contract and which was established within the scope of the compulsory insurance system, which aims to secure the unemployment risk, is the Craft’s Ahi Community Chest and the issues such as the structure, financing, scope, and the actions to be provided under the insurance are regulated in annex art.6.
