ROMA HUKUKUNUN MODERN İŞ HUKUKU ÜZERİNDEKİ ETKİLERİNE BİR BAKIŞ

Özet

İş hukukunun geliş imi, toplumsal olarak iş in nasıl algılandığı, içinde bulunulan toplumun ekonomik ve toplumsal yapısıyla doğrudan ilgilidir. Kaynağını Roma Hukukunda bulan sözleş me temelli yaklaş ım, Sanayi Devrimi öncesine ait gelenekler ve Sanayi Devrimiyle ortaya çıkan ihtiyaçlarla birleş erek Roma hukukundakine benzeyen bir iş söz- leş mesi yapısının ortaya çıkmasına yol açmış tır. Modern iş hukuklarında sözleş meden doğan karş ılıklı hak ve borçlar, ücrete iliş kin düzenlemeler, sorumluluğun dağıtılması ve riskin paylaş tırılması gibi sorunlar Roma hukukundakine benzer ş ekilde düzenlenmiş tir. İş hukukunun emredici yapısı dikkate alındığında ise bu benzerliğin kaybolduğu görülmektedir.

Abstract

The evolution of employment law is related to the perception of labour and social and economic structure of the concerned society. The contract based approach to the employment relationship coming together with the long-held traditions of the pre- Industrial Era and the needs emerged with Industrial Revolution have led the employment relationship to a contractual structure, which is similar to the one in Roman Law. In contemporary employment law, the rights and obligations arising from the contract of employment, rules about the wage, distribution of risks and responsibility are regulated in a way similar to the one in Roman law. This similarity disappears relating to the mandatory structure of the employment law.
