Özet

6356 sayılı Toplu İş Sözleş mesi ve Sendikalar Kanununun uygu- lamada karş ılaş ılan en önemli sorunları toplu iş sözleş mesinin kapsamı, düzeyi ve türlerine iliş kindir. Kanunun 33. maddesinde yeni bir kavramı oluş turan Çerçeve sözleş me düzenlemesine, 34. maddesinde sözleş - menin kapsamı, düzeyi ve türlerine iliş kin düzenlemelere yer verilmiş tir. Bu maddede uygulama için yararlı olan bazı esaslar yanında, tartış mayı ve açıklamayı gerektiren hususlar da vardır. Bu incelemede bu noktalar üzerinde durulmuş ve değerlendirmelerde bulunulmuş tur.

Abstract

In practice, the most substantially encountered problems of the law of trade unions and collective bargaining agreements, law numbered 6359 are related to the scope, the level and type of the collective bargaining agreements. The article 33 of the Law includes the framework contract which composes a new term and the article 34 includes regulations related to the scope, the level and type of the agreement. Besides the principles which avail for the practice, there are also terms require discussion and explication. It has been emphasised and evaluated on these subjects the research herein
