HACZE İŞTİRAKTE İŞÇİ ALACAKLARININ KORUNMASI*

Özet

Çalışmada, borçlunun birden fazla alacaklısının aynı mal üzerinden alacaklarını tahsil edebilmelerine imkân sağlayan hacze iştirak mü- essesesi ile işçinin korunması ilkesinin bir gereği olarak işçinin ücretinin korunmasına ilişkin düzenlemeler ele alınmış ve işçi alacaklarına tanınan imtiyazın hacze iştirak açısından değerlendirilmesi yapılmıştır. Makalede, sistematik olarak, öncelikle hacze iştirakin şartları ve paranın alacaklılara paylaştırılması aşamaları ele alınmış; ardından işçi alacakları- nın korunmasına ilişkin düzenlemelere kısaca değinildikten sonra hacze iştirak açısından işçi alacaklarının korunması hususu değerlendirilmiştir.

Abstract

In this study, garnishment participation association which allows multiple creditors to be able to collect the credit from the same goods, and the regulations about the protection of the labours' wages as a requirement of the principle of the protection of the workers are discussed and an analysis about the privilage for the workers' credit in terms of the garnishment participation is made. In the article, systematically, the conditions to the garnishment participation and the stages of the distribution of money to the creditors are handled at first; after the regulations on the protection of workers' credits is mentioned, the issue of the protection of workers' credits is evaluated in terms of garnishment participation.
