Özet
Bu çalışmada, kamuoyunun takdirine sunulan İş Mahkemeleri Kanunu Tasarısı Taslağı'na ilişkin hükümler usûl hukuku açısından incelenmiştir. Özellikle, Taslak ile getirilen zorunlu arabuluculuk kurumu ve işe iade hükümleri ile bunların Türk Hukuk sistemi açısından etkilerine yer verilmiştir. Ayrıca, Taslak ile düzenlenen diğer hükümlerin de uygulamadaki sorunlara ne derece çözüm olacağı tartışılarak değerlendirilmiş ve Taslak yasalaşmadan önce kabul edilmesi gereken bazı önerilerde bulunulmuştur.
Abstract
In this paper, draft of Code of Labour Courts, released to the public, has been examined from the point of the procedural law. Especially, has been explained the mandatory mediation and there employment lawsuit, regulated by the draft, and effect of these regulations of Turkish legal system. Also, the question as to what extent provisions in the Draft will be solutions for the practical problems has been discussed and evaluated and certain changes that are to be accepted before the draft becomes legally binding have been suggested.
